<br /> <br /> <br /> <br /> <br /> <br /> This plan specifies methods of investigation <br /> of the violation, types of escalating enforcement <br /> responses for any violation reasonably anticipated <br /> by the City and the title of the official(s) <br /> responsible for implementing each type of enforce- <br /> ment response. The enforcement response plan <br /> enables users of the POTW to anticipate enforcement <br /> action by the City. <br /> Sec. 34-117. Penalty for Violation of Article <br /> Provisions. <br /> (a) In accordance with the enforcement <br /> response plan required herein, any person in <br /> violation of any of the provisions of this article <br /> may be issued an administrative order requiring <br /> compliance and may include an administrative fine <br /> not to exceed two thousand dollars ($2000.00). <br /> Each and every days continuance of any violation of <br /> the provisions of this article shall constitute and <br /> be deemed a separate offense. <br /> (b) Any persan violating any of the provi- <br /> sions of this article shall be guilty of a mis- <br /> demeanor, and upon conviction shall be fined in any <br /> sum not to exceed two thousand dollars ($2,000.00), <br /> and each and every days continuance of any viola- <br /> tion of the provisions of this article shall <br /> constitute and be deemed a separate offense. <br /> Section 34-118 - 34-130 Reserved. <br /> DIVISION 4. TKUCKED AND HAULED WASTES <br /> <br /> Sec. 34-131 Generation, Transportation and <br /> Disposal of Wastes. <br /> <br /> (a). Non-Hazardous Wastes <br /> (1) A generator of liquid wastes shall <br /> comply with the following provisions in <br /> addition to compliance with other provi- <br /> sions of this article: <br /> a) No generator of liquid wastes <br /> shall fail to have all liquid waste <br /> material removed trom his premises by a <br /> liquid waste transporter who holds a <br /> valid permit from the city. <br /> <br /> b) No generator of liquid wastes may <br /> have hazardous wastes or liquid waste in <br /> combination with hazardous waste removed <br /> from his premises by a liquid waste <br /> transporter operating under a city <br /> permit. <br /> c) A generator of liquid wastes shall <br /> sign a City of Paris Trip Ticket from the <br /> transporter when a load is removed from <br /> his premises and keep a copy of all trip <br /> tickets for a period of one year. These <br /> records shall be made available for <br /> inspection by the City at any reasonable <br /> time. <br /> d) All generators of liquid waste shall <br /> ensure complete evacuation of liquid <br /> waste when being serviced by all <br /> permitted liquid waste transporters and <br /> shall ensure that the volume being <br /> evacuated is listed on the liquid waste <br /> transporter's trip tickEt. <br /> -33- <br />
