<br /> <br /> <br /> <br /> <br /> <br /> 3) Has failed to pay a required <br /> fee. <br /> 4) Has failed to comply with <br /> maintenance or inspection require- <br /> ments. <br /> <br /> b) The City may revoke for a period of <br /> one year or less all permits held by a <br /> transporter if the transporter or one of <br /> his employees violates any of the provi- <br /> sions of this article, any rule or <br /> regulation promulgated by the City, or <br /> applicable provisions of state or federal <br /> laws. <br /> c) A permittee whose permit is sus- <br /> pended or revoked shall not collect, <br /> transport, or dispose of any waste <br /> materials within the jurisdiction of the <br /> City. <br /> (S) Show Cause Hearing <br /> The City or its duly authorized represen- <br /> tative may order any permitted transporter to <br /> show cause before the City why the proposed <br /> suspension or revocation action should not be <br /> taken. A notice shall be served on the <br /> transporter specifying the time and place of a <br /> hearing to be held by the City or its <br /> representative regarding the violation, the <br /> reasons why the action is to be taken, and <br /> directing the transporter to show cause before <br /> the City why the proposed action should not be <br /> taken. The notice of the hearing shall be <br /> served personally or by registered or <br /> certified mail at least ten (10) days before <br /> the hearing. Service may be made on any <br /> person, or any agent or officer of a <br /> corporation. <br /> (6) Fees <br /> a) Permit <br /> Each person shall include with an <br /> applicatian for permit, a fee as may be <br /> established by Resolution of the city <br /> council. <br /> <br /> b) Waste Disposal at FOTW <br /> Waste transporters utilizing the <br /> City POTW will be charged a minimum fee <br /> equal to the fee for 1,000 gallons of <br /> liquid waste. Waste transporters may <br /> alsa be surcharged for wastes that <br /> exceed the parameters of normal domestic <br /> wastewater a.s established in Section <br /> 34-86(a) of this article. This charge <br /> will be based upon the strength as <br /> averaged by a representative number of <br /> grab samples from each load. Fees shall <br /> be reviewed on an annual basis by the <br /> City and adjusted as necessary to reflect <br /> true costs to the City. Such fees shall <br /> be established by Resolution of the city <br /> council. No wastes shall be accepted <br /> containing prohibited substances as <br /> described in Section 34-105 of this <br /> article. <br /> -39- <br />
