SECTION VII <br />SPECIAL CONDITIONS <br />1. GENERAL <br />The provisions of this section of specifications shall govern in the event of any conflict <br />between them and the "General Conditions of Agreement". <br />2. ENGINEER <br />The word "Engineer" in these specifications shall be understood as referring to <br />Dunham Engineering, Inc. of College Station, Texas, Engineer of the Owner. <br />3. OWNER <br />All references to OWNER in these documents refer to City of Paris of Paris, Texas. <br />4. EXAMINATION OF SITE OF PROJECT <br />Prospective bidders shall make a careful examination of the site of the project, climatic <br />conditions to be encountered, improvements to be performed, disposal sites for surplus <br />materials, and as to method of providing ingress and egress to any private properties, <br />and methods of handling traffic during construction of the entire project. <br />5. QUALIFICATION OF LOW BIDDER <br />Before being awarded a contract, the apparent low, responsive and responsible bidder <br />shall submit such evidence as the Engineer may require to establish his financial <br />responsibility, experience and possession of such equipment as may be needed to <br />prosecute the work in an expeditious, safe, environmentally sound and satisfactory <br />manner. <br />Before being awarded the contract, the Contractor must identify the foreman intended <br />to be assigned to the project. Once approved by the Engineer, the foreman may not be <br />removed from the job unless approved in writing by the Engineer. This specifically <br />precludes the foreman supervising more than one jobsite and specifically requires that <br />the foreman be on the jobsite 100% of the time when work is being performed. If the <br />foreman leaves the jobsite for any reason, work must cease. <br />Section VII - <br />. 426 <br />
