6. TIME ALLOWED FOR COMPLETION <br />Time allotted for the completion of all items of work shall be one hundred fifty (150) <br />days, which time shall begin on the tenth (10) day after the issuance of the Work Order. <br />The Work Order shall consist of a written request by the Engineer for the Contractor to <br />proceed with the construction of the project. <br />7. LIQUIDATED DAMAGES FOR DELAY <br />The Contractor agrees that time is the essence of this contract, and that for each <br />calendar day of delay beyond the number of calendar days herein agreed upon for the <br />completion of the work herein specified and contracted for (after due allowance for any <br />extension of time as may be granted pursuant to the General Conditions of Agreement) <br />the Owner may withhold, permanently, from the Contractor's total compensation, the <br />sum of Two Hundred Fifty ($250.00) Dollars per calendar day as liquidated damages for <br />such delay. <br />Owner and Contractor recognize that time is of the essence and that Owner will suffer <br />financial loss if the work contemplated in this Project is not completed within the time <br />specified plus any extensions allowed in change orders granted pursuant to the General <br />Conditions. Owner and Contractor recognize the delays, expenses and difficulties <br />involved in proving the actual loss suffered by Owner if the work to be completed in <br />the Project is not completed on time. Accordingly, instead of requiring any such proof, <br />Owner and Contractor agree that as liquidated damages for delay (but not as a <br />penalty), Contractor shall pay Owner Two Hundred Fifty Dollars ($250.00) per calendar <br />day for each day that expires after the time specified herein for completion of the work. <br />8. ADDENDA <br />Bidders desiring further information or interpretation of the plans or specifications <br />must make request for such information to the Engineer in writing, prior to seven (7) <br />days before the bid opening. Answers to all such requests will be given in writing to all <br />bidders, in addendum form, and all addenda will be bound with, and made a part of, <br />the Contract Documents. No other explanation or interpretation will be considered <br />official or binding. Should a bidder find discrepancies in, or omission from, the plans, <br />specifications, or other contract documents, or should he be in doubt as to their <br />meaning, he should at once notify the Engineer in writing in order that a written <br />addendum may be sent to all bidders. Any addenda issued prior to five (5) days of the <br />opening of bids will be mailed or delivered to each Contractor contemplating the <br />submission of a proposal on this work. Any addenda issued within five (5) days of bid <br />opening will be faxed or overnight mailed to each prospective bidder. The proposal as <br />submitted by the Contractor will be so constructed as to include any addenda, if such <br />are issued by the Engineer prior to five (5) days of the opening of bids. <br />Section VII - 2 <br />427 <br />
