5. DISCREPANCIES IN BIDS <br />In case of lack of clarity of a proposal, the Owner will adopt the most advantageous <br />interpretation thereof or may reject the bid. <br />6. UNBALANCED BIDS <br />Unreasonable or unbalanced unit prices that do not generally reflect industry standard <br />pricing will be cause for rejection of any bids. <br />7. INTERPRETATION OF PLANS AND SPECIFICATIONS <br />Any written questions as to the meaning of any plans and/ or specifications will be <br />answered by addendum which will be sent to all who have been furnished with <br />contract documents and plans. Questions in writing shall be directed to the Engineer <br />for consideration and response. <br />8. BID BOND <br />The bidder shall provide with the proposal a cashier's or certified check or a bid bond in <br />the amount equal to five percent (5%) of the total proposal price. <br />All bid securities will be returned to respective bidders within ten (10) days after bids <br />are opened except those which the District elects to hold until the successful bidder has <br />executed the Contract and furnished performance and payment bonds. The successful <br />bidder will receive his bid bond within ten (10) days after execution of the Contract and <br />Owner's acceptance of required performance and payment bonds. <br />9. METHOD OF AWARD <br />Contract will be awarded to the lowest responsible bidder or to the bidder who <br />provides the goods specified herein at the best value to the Owner, in compliance with <br />Texas Local Government Code, Chapter 252.043. The Owner reserves the right to select <br />the method in the best interest of the Owner. <br />Best value criteria includes but is not limited to: <br />* All costs including installation, maintenance, warranty, overall life cycle. <br />* Quality of the goods and services. <br />* Reputation of the bidder or bidder's goods and services. <br />* Extent to which goods or services meet the Owner's needs. <br />The Owner reserves the right to waive any informalities or technical errors that, in its <br />judgment, will best serve the interest of the Owner. <br />SECTION II -2 <br />, 338 <br />
