ORDINANCE N0. 86-022 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING SECTION III (6) AND SECTION XVI (B) OF APPENDIX B, SUBDIVISION REGULATIONS, ORDINANCE N0. 1315 OF SAID CODE; PROVIDING THAT FLOOD PLAINS, FLOOD-PRONE AREAS OR AREAS OF SPECIAL FLOOD HAZARDS BE SHOWN ON PRELIMINARY AND FINAL PLATS, AND PROVIDING THAT THE RULES AND REGULATIONS GOVERNING SUBDIVISIONS MAY BE SUSPENDED UPON RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION BY THE CITY COUNCIL WHEN THERE HAS BEEN A FINDING THAT THERE ARE SPECIAL CIRCUM- STANCES OR CONDITIONS EFFECTING THE PROPERTY IN QUESTION, THAT ENFORCEMENT OF THE PROVISIONS OF THE SUBDIVISION ORDINANCE WILL DEPRIVE THE APPLICANT OF A SUBSTANTIAL PROPERTY RIGHT AIvD THAT SUCH SUSPENSION, IF GRANTED, WILL NOT BE MATERIALLY DETRIMENTAL TO THE PUBLIC WELFARE OR 1NJURIOUS TO OTHER PROPERTY OR PROPERTY RIGHTS IN THE VICINITY; PROVIDING FOR A PENALTY NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOF. AN EFFECTIVE DATE OF AUGUST l, 1986. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That Section III (6) of Appendix B, Subdivision Regulations, Ordinance No. 1315 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. III. Preliminary Plat. (6) All physical features of the property to be subdivided, including location and size of all watercourses, ravines, flood plains, flood-prone areas or areas of special flood hazards, existing bridges, culverts and structures and other features pertinent to subdivision, a preliminary drainage plan, with proposed structures and drainageways with acres by class to be drained. The outline of wooded areas and the location of impor- tant individual trees may be required. „ Section 2. That Section XVI (B) Appendix B, Subdi- vision Regulations, Ordinance No. 1315 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. XVI. Changes and Variations. (B) A suspension of any of these rules and regulations may be recommended by the Commission, upon a showing that there are special circum- stances or conditions affecting the property in question; that enforcement of the provisions of this ordinance will deprive the applicant of a substantial property right; and that such suspen- sion, if granted, will not be materially detrimental to the public welfare or injurious to
