ORDINANCE N0. 83-026 AN ORDINANCE OF THE CITY OF YARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDIPdANCES, CITY OF PARIS, BE AMENDED BY REVISING SECTION 12-12 OF SAID CODE; PROVIDING FOR A PERMITTING PROCEDURE FOR OUTSIDE FIRES; PROVIDING FOR A PENALTY NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IP1 CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF JUNE l, 1983. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That Section 12-12 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 12-12.1 Outside Fires and Perr.iits for Same. "(a). It shall be unlawful for any person to burn trash, brush, grass, leaves, paper, cloth, trees, boards, planks, lumber or any other charac- ter of debris or inflammable material whatsoever out of doors in the City of Paris unless the same is contained in a fireproof container with a top that prevents the escape of sparks or cinders, unless such person has procured through the fire chief or his designee a permit permitting such burning. "(b). Outside burning permits shall be issued by the fire chief or his designee. A fee of $50.00 shall accompany any request for burning permit, such fee shall cover the inspection of the area and the material to be burned. In the event a permit is issued, it will subject to the requirements composed therein and all cost in meeting such requirements shall be born by the person requesting the permit. The requirements may include but are not limited to firelanes, civilian or fireman century watches, burn pits, extinguishing agents, the laying of firehose or the presence of other firefighting equipment. Any requirement for firefighting equipment or personnel of the City of Paris will be charged to and paid for by the permittee. The fire chief or his designee shall consider humidity, permissible wind conditions, susceptibility of vegetation to combustion, the proximity of residences and other structures, composition of material to be burned, smoke, heat and duration of burn. "Sec 12-12.2. Pluisance Fires. It shall be unlawful for any person or firm to burn any trash, rubbish, garbage or animal matter in such a manner as to create a foul and offensive odor of such extent to be detected on any adjoining property.
