<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> ORDINANCE N0. 83-026 <br /> <br /> <br /> AN ORDINANCE OF THE CITY OF YARIS, PARIS, TEXAS, <br /> PROVIDING THAT THE CODE OF ORDIPdANCES, CITY OF PARIS, BE <br /> AMENDED BY REVISING SECTION 12-12 OF SAID CODE; PROVIDING <br /> FOR A PERMITTING PROCEDURE FOR OUTSIDE FIRES; PROVIDING FOR <br /> A PENALTY NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR <br /> PARTS OF ORDINANCES IP1 CONFLICT HEREWITH; AND PROVIDING FOR <br /> AN EFFECTIVE DATE OF JUNE l, 1983. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> PARIS: <br /> Section 1. That Section 12-12 of the Code of <br /> Ordinances of the City of Paris, Paris, Texas, be amended so <br /> that such shall read as follows: <br /> <br /> "Sec. 12-12.1 Outside Fires and Perr.iits for Same. <br /> <br /> "(a). It shall be unlawful for any person <br /> to burn trash, brush, grass, leaves, paper, cloth, <br /> trees, boards, planks, lumber or any other charac- <br /> ter of debris or inflammable material whatsoever <br /> out of doors in the City of Paris unless the same <br /> is contained in a fireproof container with a top <br /> that prevents the escape of sparks or cinders, <br /> unless such person has procured through the <br /> fire chief or his designee a permit permitting such <br /> burning. <br /> "(b). Outside burning permits shall be <br /> issued by the fire chief or his designee. A fee <br /> of $50.00 shall accompany any request for burning <br /> permit, such fee shall cover the inspection of the <br /> area and the material to be burned. In the event <br /> a permit is issued, it will subject to the <br /> requirements composed therein and all cost in <br /> meeting such requirements shall be born by the <br /> person requesting the permit. The requirements <br /> may include but are not limited to firelanes, <br /> civilian or fireman century watches, burn pits, <br /> extinguishing agents, the laying of firehose or <br /> the presence of other firefighting equipment. Any <br /> requirement for firefighting equipment or <br /> personnel of the City of Paris will be charged to <br /> and paid for by the permittee. The fire chief or <br /> his designee shall consider humidity, permissible <br /> wind conditions, susceptibility of vegetation to <br /> combustion, the proximity of residences and other <br /> structures, composition of material to be burned, <br /> smoke, heat and duration of burn. <br /> "Sec 12-12.2. Pluisance Fires. <br /> It shall be unlawful for any person or firm <br /> to burn any trash, rubbish, garbage or animal <br /> matter in such a manner as to create a foul and <br /> offensive odor of such extent to be detected on <br /> any adjoining property. <br /> "Sec 12-12.3. Open Flame Torches <br /> It shall be unlawful for any person to <br /> install, erect or maintain any open flame torch on <br />
