ORDINANCE NO. 2439 . AN ORDINANCE AMENDING ORDINANCE NO. 1315 OF THE CITY OF PARIS, PROVIDING FOR THE ENFORCEMENT OF SUB- DIVISION REGULATIONS WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF PARIS, ESTABLISHING MINIMUM LOT SIZE, INCREASING THE DESIGN STANDARDS FOR SUBDIVI- SION STREET AND UTILITY CONSTRUCTION AND PROVIDING FOR THE DEVELOPER AND OWNER TO GUARANTEE THE PER- FORMANCE OF THE SAME FOR ONE (1) YEAR FROM DATE OF ACCEPTANCE OF A SUBDIVISION; PROVIDING FOR A PENALTY NOT TO EXCEED $200. 00; REPEALING ALL ORDI- NANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF. APRIL l, 1979. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That the first phrase of the caption of Ordinance No. 1315 of the City of Paris shall be amended to read as follows: "AN ORDINANCE PRESCRIBING RULES AND REGU- LATIONS GOVERNING PLATS, PLANS AND SUBDIVISION OF LAND WITHIN THE CORPORATE LIMITS AND THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF PARIS;" and a like change shall be made in the first and second "Whereas" paragraphs, the first paragraph after "BE IT ORDA INED and in the first paragraph of Section II. Section 2. That the "ORDAINED" phrase of said ordinance shall be amended to read as follows: "BE IT ORDA INED BY THE CITY COUNCIL OF THE CITY OF PARIS:" Section 3. That the following shall be added as a Sub - paragraph to Section I: "(17) Extraterritorial Jurisdiction--The phrase "Extraterritorial Jurisdiction" shall mean that unincorporated area contiguous to the corporate limits of the City of Paris to the extent described in Article 970a, Vernon's Annotated Texas Statutes. " Section 4. That Paragraph IV (11) be amended by adding a second paragraph thereto as follows: "A certificate of guarantee of the workman- ship and materials used in the construction and installation of water mains, sanitary sewer mains and street paving for a period of one (1) year from the date of acceptance of the final plat, executed by the developer and owner or owners and by all other parties who have a mortgage or lien in- terest in the property or subdivision. "
