MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL <br />APRIL 5, 2001 <br /> <br />The City Council of the City of Paris met in regular session Thursday, April 5, <br />2001, 6:00 P. M., Paris Junior College, Applied Technology Building, Room <br />1016, 2400 Clarksville Street, Paris, Texas. Mayor Michael J. Pfiester called <br />the meeting to order with the following Council Members present: Richard <br />Manning, John F. Bell, Joe E. McCarthy, and Benny Plata. Also present were <br />City Manager Michael E. Malone, City Attorney Larry W. Schenk, and City <br />Clerk Mattie Cunningham. <br />Invocation was given by Mayor Michael J. Pfiester. <br />City Manager Malone presented the minutes of the Planning and Zoning <br />Commission’s meeting held April 2, 2001, and attached hereto as Exhibit A to <br />these minutes. <br />Mayor Pf iester announced that there is an issue on the agenda that the <br />Planning and Zoning Commission had denied and further explained th at there <br />are not enough Council Members present to overturn a Planning and Zoning <br />decision. <br />City Attorney Schenk explained that the legal provision requires that if the <br />Planning and Zoning Commission denies a rezoning request, or if there were <br />a petition or a protest filed, it would take a three-quarters vote of the City <br />Council to overturn the action of the Planning and Zoning Commission. City <br />Attorney Schenk further explained that the rule requires a three-quarters vote <br />of the Council Membe rs as a body unless they are disqualified by death or <br />conflict of interest. City Attorney Schenk advised that there are two Council <br />Members absent and that a three-quarter vote is not possible. City Attorney <br />Schenk advised the City Council that they could undertake any part of the <br />agenda other than the final vote on the matter. <br />After discussion, a motion was made by Councilman Bell to move forward to <br />Agenda Item No. 13, public hearing to consider the petition of Fred Eatherly <br />for a change in zoning from a One-Family Dwelling District No. 2 (SF-2) to a <br />Multiple-Family Dwelling District No. 1 (MF-1) on Lot 7, City Block 266, being <br />located in the 1300 Block of F. M. 195, and Agenda Item No. 14, consideration <br />of and action on an ordinance amending Z oning Ordinance No. 1710, <br />changing the zoning from a One-Family Dwelling District No. 2 (SF-2) to a <br />Multiple-Family Dwelling Distric t No. 1 (MF-1) on Lot 7, City Block 266.
