APPLICANTS CERTIFICATION & PROGRAM ASSURANCES <br />TEXAS RECREATION & PARKS ACCOUNt PROGRAM <br />As the duty authorized representative of the sponsor I certify that the sponsor: <br />1. Has complied with all pertinent local and state laws, and Texas Recrearion & Parks Account Progam (TRPA) <br />requirements requiring public hearings. <br />2. Has the required proportionate share of funds available and sufficient for the project as required by Section 13.309 of the <br />Parks & Wildlife Code. <br />3. Will maintain and operate areas acquired or developed with TRPA assistance at sponsor expense as required by Section <br />13309 of the Pazks & Wildlife Code. <br />4. Will permanendy dedicate for public patk and recreauon use all project area(s) which receive TRPA assistance, as <br />required by Chapter 640.1.2 of TRPA Grants Manual Guidelines. <br />5. Has [he legal authority to apply for TRPA assistance, " the institutional, managerial and £mancial capability to ensure <br />proper planning management and complerion of the project described in this application. <br />6. Will give the State of Teras, hereafter referred to as "State", tluough any authorized representative, access to and the righ[ <br />to examine all records, books, papers, or documents related to the assistance; and will establish a proper aceounting system <br />in accordance with generally accepted accounting standards or agency d'uecrives. <br />7. Will not dispose of, modify the use of, or change the terms of the real property title, or other interest in the site and <br />facilities without permission and inshvc[ions from the Texas Parks & Wildlife Departrnent hereafter referred to as the <br />"Department" . Will record the State interest in the title of real property in accordance with Deparknent direc[ives and will <br />include a covenant in the title of real proper[y acquired in whole or in part with TRPA assistance funds to assure <br />nondiscrimination dwing the useful life of the project. <br />8. Will comply with the requirements of the Deparhnent with regard to the draffing, review and approval of construction plans <br />and specifications. <br />9. Will provide and main[ain competent engineering supervision at the construction si[e to ensure that the complete work <br />conforms with the approved plans and specifications. <br />10. Will fumish quarterly progress reports and such other information as may be required by the Deparuuent. <br />11. Will initiate and complete the work within [he applicable time frame afrer receipt of approval from the Department. <br />12. Will establish safeguards to prohibit employees from using their positions for a puipose that constitutes or presents the <br />appeazance of personal or organizational conflict of interest or personal gain. <br />13. Will comply with all State and Federal statues relating to non-discrimination. 7'hese include but are not limited to: (a) Title <br />VI of the Civil Rights Act of 1964 (P. L. 88-352) which prohibits discrimination on the basis of race, color or national <br />origin; (b) Title IX of the Education Amendments of 1972, as amended (20 U.S.C. 1681-1683, and 1685-1686) which <br />prohibits discrunination on the basis of sex; (c) Section 504 of [he Rehahilitation Act of 1973, as amended (29 U.S.C. § <br />794) which prohibit discrimuiation of the basis of handicaps; (d) the Age Discriminarion Act of 1975, as amended (42 <br />II.S.C. § § 6101-6107) which prohibits discrunination on the basis of age; (e) any other non-discrimination provisions in the <br />specific sta[ute(s) under which applicafion for TRPA assistance is being made, and (f) the requiremenu of any other <br />nondiscrimination statu[e(s) which may apply to the application. <br />14. Will comply with the flood insurance purchase requuements of Section 102(a) of the Flood Disaster Pro[ection Ac( of 1973 <br />(P.L. 93-234) which requires recipients in a special flood hazard area to participate in the program and to purchase flood <br />insurance if the total cos[ of insurable construction and acquisition is $10,000 or more. <br />(Page 1 of 2) <br />
