ARTICLE IX n JUNKED MOTOR VEHICLES ~ <br />REMOVAL FROM UNOCCUPIED PREMISES <br />BY ORDER OF CORPORATION COURT <br />If there is a junked motor vehicle, as herein defined, on <br />premises that are unoccupied, and neither the owner of the pre- <br />mises nor the owner of said vehicle can be found and notified to <br />remove same, then, upon a showing of such facts to the Judge of <br />the Corporation Court, the Court may issue an order directing the <br />Chief of Police to have the same removed, and the Chief of Police <br />or his duly authorized agent shall take possession of said junked <br />motor vehicle and remove it f rom the premises, The Chief of Police <br />or his duly authorized agent .shall thereafter dispose of said junked <br />motor vehicle in such manner as the City Council may provide. <br />ARTICLE X- EVIDENCE OF ABANDONMENT <br />If a junked motor vehicle, as defined in this Ordinance, has <br />been situated on the private property of another, witizout such per.• <br />son's permission, for a period of sixty (60) days or longer, this <br />fact shall be rp ima facie evidence that the owner of said vehicle <br />has abandoned the same. <br />ARTICLE XI - PENALTY <br />Any person violating any of the provisions of this Ordinance <br />shall be guilty of a misdemeanor and upon conviction shall be sub- <br />ject to a fine of not more than ~200.00. Each transaction in vio. <br />lation of any of the provi.sions hereof shall be deemed a separate <br />offense. <br />ARTICLE XII ~ CUMULATIVE PROVISION <br />That the provi.sions of this Ordinarr e and Ordinance No, 1406 <br />set out above shall be deemed cumulative of the provisions and regu- <br />lations contained in the Ordinances of the City of Paris her einabove <br />referred to, save and except that where the provisions of this ordi•- <br />nance and said Ordinance No. 1406 and the sections thereunder, are <br />in conflict with the provi.sions elsewhere in said Ordinances of the <br />City of Paris, then the provisions contained herein sh all prevail. <br />ARTICLE XIII - SAVINGS CLAUSE <br />It is hereby declared to be the intention of the City Council <br />that the Articles, sections, paragraphs, sentences, clauses and <br />phrases of this ordinance are severable, and if any phrase, clause, <br />sentence, paragraph, section or article of this ordinance shall be <br />declared unconstitutional or invalid by the valid judgment or de- <br />cree of any court of competent jurisdiction, such unconstitutionality <br />or invalidity shall not affect any of the remaining phrases, clauses, <br />sentences, paragraphs, sections and articles of this ordinance, since <br />the same would have been enacted by the City Council without the in•» <br />corporation in this ordinance of any unconstitutirn al or invalid <br />phrases, clauses, sentences, paragraphs, sections or articles, <br />ARTICLE XIV EFFECTIVE DATE <br />This ordinance shall become eff ective on June 24, 1968. <br />
