Within twenty days after the Effective Date of the <br />Agreement, but before CONTRACTOR starts the Work at <br />the site, a cortference attended by CONTRACTOR, ENGI- <br />NEE, R and others as appropriate will be held to discuss the <br />schedules referred to in paragraph 2.6, to discuss procedures <br />for handling Shop Drawings a~d other submittals and for <br />prOCeSsing Applications for Payment, and to establish aworking <br />understanding among the parties ~s to the Work. <br /> <br />Fiaalddng Schedules: <br /> 2.9. At least ten days before submission of the first Appli- <br />cation for Payment a conference attended by coNTRAC- <br />TOR, ENGINEER and others as appropriate will be held to <br />finalize the schedules submitted in accordance with para- <br /> <br />*See Supplementary Conditions <br /> <br />graph 2.6. Thc finalized progress schedule will be acceptable <br />to ENGINEER as providing an orderly progression of the <br />Work to completion within the Contract Time, Er~'- such <br />acceptance will neither impose on ENGINEER resP°asibitity <br />for the progress or scheduling of the Work nor relieve CON- <br />TRACTOR from full responsibility therefor. The finalized <br />schedule of Shop Drawing submissions will be acceptable to <br />ENGINEER as providing a workable arrangement for pro- <br />cessing the submissions. The finalized schedule of values wit[ <br />be acceptable to ENGINEER as to form and substance. <br /> <br />ARTICLE 3__coNTRACT DOCUMENTS: INTENT, <br /> AMENDING, REUSE <br /> <br />Intent: <br /> 3.1. The Contract Documents comprise the enr re .agree- <br />ment between OWNER and CONTRACTOR concerning the <br />Work. The Contract Documents are complementary; what is <br />called fo~: by one is as binding as if called for by all. The <br />Contract Documents will be construed in accordance with <br />the law of the place of the Project. <br /> * 3.2. itistheintentoftheContractDocumentst°describe <br /> a functionally complete Project (or part thereot') to be con- <br /> str:ucted in accordance with the Contract Documents. Any <br /> Work, materials or cqulpment that may reasonably be inferred <br /> from the Contract Documents as being required to produce <br /> the intended result will be supplied whether or not specifically <br /> called for. When words which have a wall.known technical <br /> or trade meaning are used to describe Work, materials or <br /> equip ment such words shall be interpreted in accordance with <br /> that meaning. Reference to standard specificatiods, manuals <br /> or codes of any technical society, organization or association, <br /> or to the Laws or Regulations of any governmental authority, <br /> whether such reference be specific or by implication, shall <br /> mean the latest standard specification, manual, code or Laws <br /> or Regulations in effect at the time of opening of Bids (or, on <br /> the Effective Date of the Agreement if there were no Bids), <br /> except as may b¢ otherwise specifically stated. Floweret, no <br /> provision of any referenced standard specification, manual <br /> or code (whether or not specifically incorporated by reference <br /> in the Contract Documents} shall be effective to change the <br /> duties and responsibilities of oWNER, CONTRACTOR or <br /> ENGINEER, or any of their consukants, agents or employ- <br /> ecs from those set forth in the Contract Documents, nor shall . <br /> it be effective to assign to ENGINEER, or any of ENGI- <br /> NEER's ¢oasuRants, agents or employees, any duty or <br /> authority to supervise 0r direct the furnishing or performanc.e <br /> of the Work or any duty or authority to undertake respons~- <br /> billty ¢outrkry to the provisions of paragraph 9.15 or 9.16. <br /> Clarifications and interpretations of the Contract Documents <br /> shall be issued by ENGINEER as provided in paragraph 9.4. <br /> 3.3. If, during the performance of the Work, cONTRAC- <br /> TOR finds a conflict, error or discrepancy in the Contract <br /> Documents, CONTRACTOR shall so report to ENGINEER <br /> in writing at once and before proceeding with the Work affected <br /> thereby shall obtain a written interpretation or clarification <br /> <br /> <br />
