If any part of CONTRACTOR's Work depends for <br />proper execution or results upon thc work of any such other <br />contractor or utility owner (or OWNER), CONTRACTOR <br />shall inspect and promptly report to ENGINEER in writing <br />any delays, defects or deficiencies in such work that render <br />it unavailable or unsuitable for such proper execution and <br />results. CONTRACTOR's failure so to report will constitute <br />an acceptance of the other work as fit and proper for integra- <br />tion with CONTRACTOR's Work except for latent or non- <br />apparent defects and deficiencies in the other work. <br /> <br />tufts which hove been utilized by ENGINEER in preparing <br />thc Drawings and Specifications. <br /> <br /> 8.5. Paragraph 1.5.2 <br />deals With OWNER's right to terminate services of CON- <br />TRACTOR under certain circumstances. <br /> <br />ARTICLE 9--ENGINEER'S STATUS DURING <br /> CONSTRUCTION <br /> <br />Coordination: <br /> 7.4. Unless other,vise provided in the Supplementary <br />Conditions. neither OWNER nor ENGINEER shall have any <br />authority or responsibility in respect or- such coordinatlon. <br /> <br />ARTICLE 8~OWNER'S RESPONSIBILITIES <br /> <br />8.1. OWNER shall issue all communications to CON- <br />TRACTOR through ENGINEER. <br /> <br /> 8.2. In case cf termination of the employment of ENGI- <br />NEER. OWNER shall appoint an engineer against whom <br />CONTRACTOR makes no reasonable objection, whose sta- <br />tus under the Contract Documents shall be that or- the former <br />ENGINEER. Any dispute in connection with such appoint- <br />ment shah be subject to arbitration. <br /> <br /> 8.3. OWNER shall furnish the data required of OWNER <br />under the Contract Documents promptly and shall make pay- <br />merits to CONTRACTOR promptly after they are due as <br />provided in paragraphs 14.4 and 14.13. <br /> <br /> 8.4. OWNER's dutles in respect of providing lands and <br /> easements and providing engineering surveys to establish <br /> reference points are set forth in paragraphs 4.1 and 4.4. Para- <br /> graph 4.2 refers to OWNER's identifying and making avail- <br /> able to CONTRACTOR copies of reports of explorations and <br /> tests of subsarfacc conditions at the site and in existing sitar- <br /> <br /> *See Supplementary Condicfon~ <br /> <br /> 9,1. ENGINEER will be OWNER's representative dur- <br />ing the construction period. The dudes and responsibilities <br />and the limitations or'authority oFENGINEERas OWNER's <br />representatlve during construction are set forth in the Con- <br />tract Documents and shall not be extended without xvritten <br />consent of OWNER and ENGINEER. <br /> <br />Vixlt$ to Site: <br /> <br /> 9.2. ENGINEER will make visits to the site at intervals <br />appropriate to the various stages of construction to observe <br />the progress and quality or- the executed Work and to-deter- <br />mine, in general, if the Work is proceeding in accordance <br />with the Co ntract Documents. ENGINEERwilI not be required <br />to make cxhaustive or continuous on-site inspections to check <br />the quality or quantity ot- the Work. ENGINEER's efforts <br />will be directed toward providing for OWN ER a greater degree <br />of confidence that the completed Work will conform to the <br />Contract Documents. On the basis of such visits and on-site <br />observations as an experienced and qualified design profes- <br />slon,al, ENGINEER will keep OWNER int-ormed of the prog- <br />ress of the Work and will endeavor to guard OWHER a~inst <br />defects and deficiencies in the Work. <br /> <br /> Project Reprexentat~on: <br />* 9.3. If OWNER and ENGI.NEER agree, ENGINEER <br />will furnish a Resident Project Representative to assist <br />ENGINEER in observing the performance of the Work. The <br />duties, responslbEitles and limitations of authority of any <br />such Resident Project Representative and assistants wile be <br />as provided in the Supplementary Conditions.
