AN ORDINANCE DECLARIIVG THE NECESSITY FOR AND ORDERING THE IMPROVEMENT OF CERTAIN STREETS AND PORTIONS THEREOF, IN THE CITY OF PARIS, DEFINING THE IMPROVEMENTS AND SPECIFI- CATIONS FOR SUCH WORK, I?IRECTING THE PREPAR.ATION OF E5TI•- MATES OF THE COSTS THEREOF, IIVVOKING THE PROCEI?URE RE- QUIRED BY ARTICLE 1105b, REVISED GIVIL STATUTES OF TEXAS AND THE CHARTER OF THE CITY OF PARIS AI?OPTING SUCH STATUTE, DE- TERIvIINING THAT A PORTION OF THE COSTS SHALL BE BORNE BY THE CITY ANI? THE BALANCE THEREOF 5HALL BE BORNE BY THE ABUTTING PROPERTIE5 AND THE OWNERS THEREOF, PROVII?ING FOR THE ASSESS- MENT OF THE PORTION OF THE COSTS TO BE BORNE BY THE PROPERTY OWNERS, PROVIDING FOR THE FIXING OF A LIEN TO SECURE THE PAY- MENT OF SUCH ASSESSMENTS, SETTING THE TIME ANI? MANNER PRO- POSED FOR THE PAYMENT OF SUCH COSTS, DIRECTING THE CITY CLERK TO CAUSE A NOTICE OF THE ENACTMENT OF THIS ORDINANCE TO BE FILED IN THE MORTGAGE OR DEED OF TRUST RECORDS OF LAMAR COUNTY, TEXAS, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That a necessity exists for the improvement of those cer- tain portions of the public streets hereinafter listed, by scarifying the existing flexible base, adding additional flexible base where needed, shaping and compacting the flexible base, priming the surfa.ce with asphalt, applying a wearing surface of asphalt and coverstone, and rolling the surface and brooming the same after the application of the coverstone, and such im•• provements are hereby ordered, the portions of the public streets to be so improved being designated and defined as follows, to..wit: (1) West Houston 5treet, from the West Boundary Line of 13th Street, N. W. to the East Boundary Line of 17th Street, N. W. (2) 14th Street, N. W., from the North Boundary Line of Graham Street to the South Boundary Line of West Cherry Street. Section 2. The streets and portions thereof shall be improved and finished as set out in Section 1, above. Section 3. That the City Manager has filed an estimate of the cost of the above improvements, the same to be done by the forces of the City of Paris, and has estima.ted the cost of seventy-five cents (75~) per front foot for said improvements, and in addition the use of machinery now owned by the City of Paris. Section 4. The City Council of the City of Paris deems it advisable and hereby determines to proceed under and in exercise of the powers, terms, and provis ions of Article 1105b, R. C, S. , 1925, and the provisions of the Charter of the City of Paris adopting said statute of the Sta.te of Texas. Section 5. The costs of said improvements shall be paid as follows: (a) The City of Paris shall pay all costs of any necessary drainage installations and all of the additional costs in excess of fifty cents (50~) per centerline foot on said project.
