ORDINANGE NO. 1490 , AN ORDINANCE DECLARING THE NECES5ITY FOR AND ORI)ERING THE IMPROVEMENT OF A CERTAIN STREET AND PORTIONS THEREOF, IN THE CITY OF PARIS„ DEFINING THE IMPROVEMENTS ANID SPECIFI- CATIONS FOR SUCH WORK, I?IRECTING THE PREPA.RATION OF ESTi- MATES OF THE COSTS THEREOF, INVOKING THE PROCEDURE RE- QUIRED BY ARTIBLE 1105b, REVISED CIVIL STATUTES OF TEXAS AND THE CHARTER OF THE CITY OF PARIS ADOPTING SUCH STATUTE, DE- TERMINING THAT A PORTION OF THE COSTS SHALL BE BORNED BY THE CITY AND THE BALANCE THEREOF SHALL BE BORNE BY THE ABUTTING PROPERTIES AND THE OWNERS THEREOF, PROViDING FOR THE A5SESSMENT OF THE PORTION OF THE GOSTS TO BE BORNE BY THE PROPERTY OWNERS, PROVIDING FOR THE FIXING OF A LIEN TO SECURE THE PAYMENT OF SUCH ASSESSMENTS, SETTING THE TIME AND MANNER PROPOSED FOR THE PAYMENT OF SUCH COSTSF DI- RECTING THE CITY CLERK TO CAUSE A NOTICE OF THE ENACTMENT OF THIS ORDINANCE TO BE FILED IN THE MORTGAGE OR DEED OF TRUST RECORDS OF LAMAR COUNTY, TEXAS, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That a necessity exists for the improvement of those cer- ta,in portions of the public street hereinafter listed, by scarifying the existing flexible base, adding additional flexible base wtiere needed, sha.ping and compacting the flexible base, priming the surface with aspha.lt, apply- ing a wearing surface of asphalt and coverstone, and rolling the surfa.ce and brooming the same after the application of the coverstone, and such improvements are hereby ordered, the portions of the public street to be so improved being designa.ted and defined as follows, to-wit: (1) 28th Street, N. E„ from the North Boundary Line of East Price Street to the South Boundary Line of East Cherry Street, Section 2. The street and portions thereof sha.ll be improved and finished as set out in Section 1, above. Section 3. That the City Ma.nager ha.s filed an estimate of the cost of the above improvements, the same to be done by the forces of the City of Paris, and has estimated the cost of seventy-five cents (75~) per front foot for said improvements, and in addition the use of ma.chinery now owned by the City of Paris. Section 4. The City Council of the City of Paris deems it advisable and hereby determines to proceed under and in exercise of the powers, terms, and provisions of Article 1105b, R. C. S,, 1925, and the provisions of the Charter of the City of Paris adopting said sta.tute of the Sta.te of Texa.s. Section 5. The costs of said improvements shall be paid as follows: (a) The City of Paris sha.ll pay all costs of any necessary drainage installations and all of the additiona.l costs in excess of fifty cents (50~) per centerline foot on said project. (b) The remainder of the costs of said improvements, in the amount of fifty cents (50~) per centerline £xont foot shall
