Section 3. PERMITS - It shall be unlawful for any person to bring <br />into, send intop or receive into the City or its police jurisdiction, for sale, <br />or to sell, or offer for sale there3n, or to have in storage where milk or milk <br />products are sold or served, any mi.lk or milk products defined in this ordi- <br />nance, who does not possess a permit from the health officer of the City. <br />Every milk producer, milk hauler, milk distributor, and operator af a <br />milk plant shall secure a permit. Ociy a person who complies with this ordin- <br />ance shall lx entitled to receive and retain such a permit. Permits shall nct <br />be transferable with respect to persons and/or locations. <br />Such a permit may be temporarily suspended by the health officer upon <br />violation by the holder of any of the terms of this ordinance, or for inter- <br />ference with the health officer in the performance of his duties, or may be <br />revoked after an opportunity for a hearing by the health officer upon serious <br />or repeated violations. <br />FEES. Every milk producer, milk hauler or operztor of a dairy or dairy <br />farm shall make application to the Director of the Paris-L.anaar County Health <br />Unit, upon forms prescribed and furnished by the Director, for z permit to pro- <br />duce milk, operate and do business in the City of Paris. Such person shall pay <br />therefor in advance the sUtn of Five ($5.00) Dollars, and thereupon shall receive <br />a permit in writing to produce milk, operate and eb business in said City in <br />accordance with the provisions of this ordinance, which permit, unless revokad <br />as herein provided, shall continue in force until the end of the calendar year <br />in which such permit is issued, and such permit shall be non-transferable and <br />shall be annually renewed upon application and payment of a like sum in <br />accordance with and sub3ect to the conditions and terms of this ordinance. <br />Every rnilk distributor, whether of Grade A pastearized aailk and/or milk <br />products or Grade A raw milk and/or milk products, and every operator of a milk <br />plant doing business in the City of Parf.s or vvithin its police jurisdiction <br />shzll maka applicati,an in writing to the Director of the Paris-Lamar County <br />Health Unit, upon forms prescribed and furnished by said Director, for a per- <br />mit to distribute milk and/or milk products and tooperate and do business in <br />the City of Paris, paying therefor in advznce a fee of One Hundred Fifty <br />($150.00) Dollars for a permit authorizing such persvn, firm or ccpporation, <br />to distribute milk and/or milk products and to operate and do btasiness in the <br />City of Paris for a period of one year from the dafieihereof, and thereafter, <br />at the end of each calendar month during such permit year every such milk <br />distributor and/or operator of a milk plant shall make a written repat to the <br />health officer showing the total amount of such milk and/or milk products pro- <br />duced, processed and/or distributed in the City of Paris during such preceding <br />calendar month. Upon receipt of such report, the health officer shall compute <br />in accordance with the following schedule the additional fee to be paid by any <br />such permit holder and prepare invoices therefor in triplicate, scnding one of <br />such invoices to the permit holder, one to the City Clerk of the City of Paris, <br />and retaining the third for his files. Thereafter, within ten (10) days from <br />the date of such invoice, such permit holder shall pay to the City of Paris <br />monthly the additional fee shoam by such invoice, such fee to be computed as <br />follo A~ he pt~e o thirty (30) cents per one thousznd (1000) gallonq of <br />e <br />milk,pro6 c2d; process d'or distributed within the City of Paris. In the <br />event that any person, firm or corporationshall operate in thc City of Pzris <br />both a milk plant and as a distributor of milk and/or milk products, such <br />permit holder shall be required to secure only one permit, and shall be required <br />ta report only that phase of his operations which is the greater byvolume, that <br />is his production or his distribution, whichever is the greater by voluune, and <br />shall pay the fees hereinbefore prescribed for such operation. <br />Any permit granted pursuant to the provisions of this Section shall be <br />immediately revoktd by the Director of the Health Unit upon failure of any <br />permit holder to promptly pay the fees prescribed by this Section, and such <br />permit shall be non-transferable and shall be zenewed annually in accordance <br />with and subject to the terms and conditions of this ordinance. <br />
