DAIRY, OR DAIRY FARM - A dairy,0 or dairy farmg is any place or <br />premises where one or more cows,are keptl a part or all of the milk or milk <br />products fram which is sold or offered for sale. <br />p-1, PROD[C€R DAIRY - A producer dairy is a dairy farm which sends <br />milk or cream to a milk plant for processing. <br />p•2. MIIK HAUIER - A milk hauler is any personI other than a milk <br />prodvicer or a milk-plant employees who transports milk and/or milk products <br />to or froma milk plant or a collecting plant. <br />Q. ZIK pIANT - A milk plant is any place# premisesg or establishment <br />where milk or milk products are collectedg handled, processedg storedo pas- <br />teurizedl bottledp or prepared for distributiong except an establishment where <br />milk or milk products are sold at retail only. <br />R. I-EALTH OFFICER - The term "health officer" shall mean the Directarr <br />of the Department of Public Health a~dt~.3a~ce of the City of PTwOpOtolU ~ or <br />his authorized representatives. <br />R-1. STATE HEALTH OFFIGER - The term "State Health Officer" shall <br />mean the State Health Officer of the State of Texas. <br />S. AVERAGE BACTERIAL PIA1E Q}UNTq DZRECT MICRiOSCQPIC CAUNT9 AND (700LIA1G <br />TEMPERATURE - Average bacterial plate count and average direct microscopic <br />count shall be taken to mean the logarittumic averageg and average caoling <br />temperature shall be taken to mean the arithmetic average of the respective test <br />results of the last four consecutive samples, taken upon separate days, irre- <br />spective of the 6-month period referred to in Section 6. <br />T. PERSON - The word "person" shall mean any individualp partnershipp <br />corporations, companyg firm, trusteeor association. <br />U. AND/OR - Where the term "and/or" is usedo "and" shall apply where <br />possible, otherwise "or" shall apply. <br />Section 2. Tl-E 5AIE OF ADULIERATED, MISBBAAmED 9 OR UNGRADED hff I1C OR <br />MI Lc PR0DUCTS PROHIBITED - No person shallp within the City of Paris or its <br />police jurisdiction# produce, sellg offer or expose for salet or have in <br />possession with intent to sells any milk or milk product which is adulteratedo <br />misbranded, or ungraded. It shall be unlawful for any persong elsewhere than <br />in a priitate home, to have in possession any adulteratedt misbranded, or un- <br />graded milk oxmilk products PROVIDED that in an emergency the sale of ungraded <br />pasteurized milk or pasteurized milk products may be authorized by the health <br />officer, upon the approval of the State health authoritys in which case they <br />shall be labeled "ungraded." <br />Any adulterateds misbrandedp and/or improperly labeled milk or milk <br />products may be in►pounded by the health officer and disposed of in accordance <br />with State law. <br />
