<br /> <br />82 <br /> <br />Sidewalks, <br /> <br />cause the sidewalk to be built at the expense of the city, by letting <br />the work out on contract to the lowest and best bidder, after ad- <br />vertising a notice of the contract to be let for the space of five days. <br />And when any sidewalks are constructed at the expense of the city <br />the cost of ~onstruction, together with the cost of collection, shall <br />be a valid charge against the owners of such lot, or lots, or blocks, <br />and a lien and incumbrance upon the lot, or lots, or block of land <br />in front of which such sidewalk is constructed, which amount shall <br />be collected from the owner, or owners of the property, and un- <br />less the same is immediately paid it shall be the duty of the city <br />attorney, when ordered by the city council, to institute suit against <br />the proper owner, or owners of the property for the collection of <br />the same, and to foreclose the lien on such property. <br />SEC. 5. It is the further duty of all persons owning property <br />fronting on any sidewalk to keep the sidewalk in front of their <br />own property in good repair and clear of obstruction, except such <br />obstruction as may be permitted by ordinance, and in case any <br />person so owning property shall fail to immediately repair his side- <br />walk when notified by the city engineer, then the city council may' <br />cause the repairs to be made a,t the expense of the owner by ad- <br />vertising .nd letting out the contract as required in section 4 of <br />this ordinance for building sidewalks, and the cost and expense of <br />the repairs, as well as the cost of collection, shall be taxed against <br />the property and shall be a lien upon the property fronting such <br />sidewalk repaired, and the council may at any time order the city <br />attorney to sue for the same and to foreclose such lien. The city <br />engineer may give the notice verbally to the owner in person, or <br />his agent, or in writing, and in case the owner is absent from the <br />city, or is a non-resident, then a notice may be given by causing <br />such notice to be published in the official paper, in three consecu- <br />tive issues of such paper. <br />SEC. 6. The city engineer shall superintend the construction <br />and repairs of all sidewalks, whether the same be constructed or <br />repaired by the city or property owner. He shall drive stakes, <br />give the grade, and see that the work is done in accordance with <br />the requirements of the city ordinance. <br /> <br />1 <br />
