The term for rental of all such hangars shall be on a month-to- <br />month basis. <br /> <br /> "(3) Payment. Payment for all rentals is due and must be received by the City by <br />or before the first day of each month. Failure to make such payment on a timely basis <br />shall constitute default and subject the tenant to removal or any other remedies as the <br />City shall have under the law. <br /> <br /> "(4) Termination. Failure to timely make payment of the monthly rentals due as <br />specified herein shall constitute due cause for the City to terminate the tenant's <br />month-to-month use of the hangar. Likewise, any other use or misuse of the hangar <br />in accordance with rules and regulations adopted by the City shall likewise constitute <br />justification for termination. If the City Manager, or his lawful designee, shall <br />determine that a tenant has failed to make timely payment of the rentals due, or has <br />failed to abide by rules and regulations established by the City for the use of said <br />hangars, the City Manager may, by written notice personally delivered to the tenant <br />or delivered by certified mail, return receipt requested, provide notice of intent to <br />terminate the rental arrangement with the current tenant. Such termination notice <br />shall be effective thirty (30) days from receipt thereof by the tenant, or at such later <br />time as shall be specified in the notice. Upon receipt of such notice, the tenant shall <br />immediately vacate the premises. Failure to timely vacate the premises upon receipt <br />of notice of termination shall constitute a breach of the month-to-month arrangement <br />for use of the premises, and the City may seek any and all remedies available to it <br />under the law, including the filing of a proper eviction action to forcibly remove the <br />tenant from the premises. If such action is necessary, the tenant shall be required to <br />pay any and all attorneys' fees and costs incident to said eviction." <br /> <br /> Section 3. That all ordinances or resolutions or parts of ordinances or resolutions in conflict <br />herewith are expressly repealed. <br /> <br />Section 4.
