City Council Meeting
October 9, 2000
Page 5
and the problem with not going forward in the lawsuit is that the City of
Paris will be jeopardizing the city's position when they use the base line,
and if they find it incorrect, and the city is using a lot more kilowatt hours
or a lot fewer kilowatt hours and the gross receipt numbers were incorrect,
then the only way you can really correct that situation is to join in this law
suit. Ms. Richardson said the settlement that comes out of this will be
specific to the City of Paris and it will be based on the real numbers. Ms.
Richardson advised the City Council that they were still in the discovery
phase and they have requested information on all municipalities so that
Denton is not alone and in some cases they have not been able to get any
information because when Lone Star Gas and TXU merged, they can not
seem to find some of the basic information to tell them what the gross
receipts were and how they determined the funds that should have gone
to the cities.
After further discussion with Ms. Richardson, a motion was made by
Councilman Plata, seconded by Councilman Bell, for approval of the
resolution. The motion carried 7 ayes,0 nays.
Resolution No. 2000-141, resolving thatthe city Council of the City of Paris,
Paris, Texas, hereby authorize the execution of two tax sales deeds to
Ashley Redhead II & Akwokwo Olabisi for Lot 2, Block 1, Lane Place
Addition, Lot 18, Block Q, East Park Addition, and Lot 19, Block P, East
Park Addition, was presented.
