City Council Minutes <br />September 13, 2000 <br />Page 11 <br />the litigation. <br />James Blanton, representing TUX Electric, came forward telling the City <br />Council that he has another brief on the HL&P case as to how it compared to <br />this litigation. Mr. Blanton pointed out that the language as far as the Paris <br />franchise is similar to that of the Denton franchise, TXU still feels that they are <br />paying the franchise as stated in the franchise. He said that one of the issues <br />that Mr. Schenk brought up was that the City of Denton is also filing suit for <br />the gas franchise fees, and one of those issues that came up in the Denton law <br />suit, just to give you an idea of how franchises are different from city to city <br />depending what you negotiated for, as these are contracts between TXU and the <br />city, is that the City of Denton is stating that TXU is not paying franchise fees <br />on transportation for gas into the city to large industrial customers for gas that <br />was deregulated awhile back. Mr. Blanton said what the City of Denton is <br />saying is TXU is not paying franchise fees on the transportation of gas to those <br />industries. Mr. Blanton said it was not in the franchise to pay those fees, and <br />advised the City Council that the City of Paris's franchise states that they will <br />pay on the transported gas into the city limits of the City of Paris. He said <br />another thing to keep in mind is when you are working on a franchise, the fees <br />that are involved in the franchise are going to be paid by someone at some <br />point in time. <br />After a considerable amount of discussion, a motion was made by Councilman <br />Plata, seconded by Councilman McCarthy, to table action on the resolution <br />approving the City of Paris' participation in the Denton v. TXU Utilities <br />Company, et al., case relating to delinquent franchise fees. The motion carried <br />6 ayes, 0 nays. <br />Resolution No. 2000-131, authorizing the City Manager to purchase a 1990 <br />model Ford F800 Dump Truck, VIN No. DXK84AOLVA11223, State General <br />Services Commission inventoryNo. 03967E, for a purchase price of $8,600.00, <br />was presented. A motion was made by Mayor Pro Tem Manning, seconded by <br />Councilman McCarthy, for approval of the resolution. The motion carried 6 <br />
