City Council Meeting <br />September 7, 2000 <br />Page 7 <br />when the children are dropped off. Ms. Fleming said she is located within 2/10 <br />of a mile for Aiken Elementary School and her street is within the school zone, <br />which during the hours of 7:15 A. M. and 8:15 A.M. there is a 20 MPH school <br />zone. Ms. Fleming said she is regulated by the State of Texas, she has her <br />license, which is a requirement for a group day home, and they do monitor the <br />homes regularly. Ms. Fleming said she had to get a fire and health inspection <br />before she could consider opening her home up to children. Ms. Fleming said <br />state law will not allow her to let the children run down the street. They are <br />allowed certain times on the playground, which would be in her backyard, and <br />she is within the limits regarding space, which is 80 square feet per child. <br />Michael Topliff, County Road 44700, came forward speaking in behalf of Ms. <br />Nell Fleming. He said that before tonight, he did not know Ms. Fleming, but <br />he knew the children that she takes care of. Mr. Topliff said he had talked to <br />a realtor regarding a group day home and he said it would not devalue the <br />property, but would increase the value of the property because of the school <br />being located so close to Ms. Fleming's home. Mr. Topliff said he called Aiken <br />Elementary and talked to the secretary, and she told him that they have 1,065 <br />students there, which approximately 400 are dropped off by the parents, and he <br />could not see that eight additional vehicles are going to create any type of <br />traffic hazard. <br />Jerry Newberry, Route 2, Box 92, Paris, Texas, appeared before the City <br />Council stating that he is in favor of what Mr. and Mrs. Fleming are wanting <br />to do. Mr. Newberry told the City Council that he and his wife are looking at <br />sending their daughter to this home for care. Mr. Newberry urged the City <br />Council to vote in favor of Ms. Fleming. <br />Brandon Fleming, 640 Margaret Street, appeared before the City Council <br />speaking in favor of the petitioner and presented a visual of the houses that <br />were in favor of the day care and explained that the houses in purple have all <br />said their driveways could be used for parents to back out and go back to Pine <br />Mill Rd. He said the houses in red are the ones that spoke against the zoning <br />
