Mr. Becker said they have five day service <br />at this time and if this is taken way, you do not have a guarantee that will <br />happen again. He said what you would be giving up is what you have <br />proof of right now. Mr. Becker said that, as far as competition, you might <br />want to look at that because if they can not get to all of the classes, the <br />ones like Kiamichi has access to right now with B&SF, UP at Grant for the <br />west market, UP at Hope Arkansas for the east market, and Kansas City <br />from the north to south to the Louisiana and Gulf areas, then you would be <br />losing service. Mr. Becker stated that the city has everything they are <br />asking for. He said the city has available now all the class ones that you <br />could askforand even have competition and a reasonable rate. Mr. Becker <br />asked that the city to do a lot more research by asking customers in the <br />city and make sure what he is saying is true. <br />After further discussion, a motion was made by Councilman Bell, <br />seconded by Councilman McCarthy, to table action on this resolution. The <br />motion carried 7 ayes, 0 nays. <br />Resolution No. 2001-010, affirming that the City of Paris has complied with <br />the requirements of the Public Funds Investment Act; amending the City's <br />investment policy; making other findings and provisions related to the <br />subject, and providing for an effective date, was presented. A motion was <br />made by Mayor Pro Tem Manning, seconded by Councilman Bell, for <br />approval of the resolution. The motion carried 7 ayes, 0 nays. <br />Resolution No. 2001-011, resolving that the City Council of the City of <br />Paris, Paris, Texas, hereby officially declines to consider the complaint of <br />the Texas Department of Transportation against Texas Utilities Electric <br />Company filed January 29, 2001, whereby the Texas Department of <br />Transportation seeks a refund for overcharges related to photocell <br />controlled lighting inside the corporate limits of the City of Paris. That the <br />City Council further refuses action on said complaint, and the City Council <br />defers jurisdiction over said complaint to the Public Utility Commission of <br />Texas, was presented. A motion was made by Councilman Plata, <br />seconded by Councilman McCarthy, for approval of the resolution. The <br />motion carried 7 ayes, 0 nays. <br />Resolution No. 2001-012, approving the Owner-Occupied Rehabilitation <br />Program Design, HOME No. 530395, and authorizing and directing the City <br />Manager to execute on behalf of the City of Paris the Owner-Occupied <br />
