Government Code - CHAPTER 2303 Page 8 of 28 <br />(a) The department may deny an application for the designation of an enterprise zone only if the <br />department determines that the nominated area does not satisfy the criteria under Section 2303.101. <br />(b) The department shall inform the nominating body of the specific reasons for denial of an <br />application, including denial under Section 2303.107(e). <br />Added by Acts 1993, 73rd Leg., ch. 268, § 1, eff. Sept. 1, 1993. <br />§ 2303.109. Period of Designation <br />(a) An area may be designated as an enterprise zone for a maximum of seven years. A designation <br />remains in effect until September 1 of the final year of the designation. <br />(b) Notwithstanding Subsection (a), an area designated as a federal enterprise zone, federal <br />empowerment zone, or federal enterprise community may be designated as an enterprise zone without <br />further qualification for longer than seven years but not longer than the period permitted by federal law. <br />Added by Acts 1993, 73rd Leg., ch. 268, § 1, eff. Amending Boundaries <br />(a) The nominating body may amend the boundary of an enterprise zone by ordinance or order, as <br />appropriate, adopted after a public hearing on the issue. <br />(b) The amended boundary: <br />(1) must be continuous; <br />(2) may not exceed the original size requirement of Section 2303.101; and <br />(3) may not exclude any area originally included within the boundary of the zone as designated. <br />(c) The entire enterprise zone with the amended boundary must continue to meet the unemployment <br />and economic distress requirements of Section 2303.101. <br />(d) A nominating body may not make more than one boundary amendment annually for an enterprise <br />zone. <br />(e) For each amendment of an enterprise zone boundary, the nominating body shall pay the <br />department a reasonable fee, in an amount specified by the department, not to exceed $500. The <br />department may use fees collected under this subsection to administer this chapter and for other <br />purposes to advance this chapter. <br />Added by Acts 1993, 73rd Leg., ch. 268, § 1, eff.
