Government Code - CHAPTER 2303 Page 9 of 28 <br />(1) the area no longer meets the criteria for designation under this chapter or by department rule <br />adopted under this chapter; or <br />(2) the department determines that the governing body of the enterprise zone has not complied with <br />commitments made in the ordinance or order nominating the area as an enterprise zone. <br />(b) The removal of a designation does not affect the validity of: <br />(1) a tax incentive or regulatory relief granted or accrued before the removal; or <br />(2) bonds issued under this chapter. <br />Added by Acts 1993, 73rd Leg., ch. 268, § 1, eff. Exception to Limit on Designation <br />Designation as an enterprise zone under this chapter of an area designated as a federal enterprise <br />zone, federal empowerment zone, or federal enterprise community located in a municipality or county <br />does not reduce the number of enterprise zones that the municipality or county may have designated <br />under this chapter. <br />Added by Acts 1995, 74th Leg., ch. 985, § 5, eff. Sept. 1, 1995. <br />SUBCHAPTER D. ADMINISTRATION OF ENTERPRISE ZONE <br />§ 2303.201. Administration by Governing Body <br />The governing body of an enterprise zone is the governing body of the municipality or county, or the <br />governing bodies of the combination of municipalities or counties, that applied to have the area <br />designated as an enterprise zone. <br />Added by Acts 1993, 73rd Leg., ch. 268, § 1, eff. Sept. 1, 1993. <br />§ 2303.202. Administration by Administrative Authority <br />(a) The governing body of an enterprise zone may delegate its administrative duties to an <br />administrative authority appointed by the governing body. <br />(b) An administrative authority must: <br />(1) be composed of 3, 5, 7, 9, 11, or 15 members; <br />(2) be a viable and responsive body generally representative of all public or private entities that have <br />a stake in the development of the zone; and <br />(3) include enterprise zone residents and representatives of the governing body of the zone and of <br />local businesses. <br />Added by Acts 1993, 73rd Leg., ch. 268, § 1, eff.
