JUNE 28, 2002 <br /> <br />TO: <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />PARIS CITY COUNCIL <br /> <br />STEVE METHVEN, BUILDING OFFICIAL <br /> <br />ZONING CHANGE REQUEST OF FAULK & FOSTER <br /> <br />THE ABOVE REQUEST WAS TABLED BY CITY COUNCIL IN APRIL FOR REVIEWING <br />OF THE TOWER ORDINANCE AND ZONING. MY RECOMMENDATION TO THE <br />COUNCIL IS NOT TO CHANGE THE ZONING. THIS PROPERTY IS THE BIG TEX FEED <br />PLANT LOCATED AT 3720 LAMAR AVENUE. WHEN THE PROPERTY WAS ANNEXED <br />INTO THE CITY, THE COUNCIL DID NOT WANT TO EXTEND LIGHT INDUSTRIAL <br />ZONING IN THE AREA. THEREFORE, THE PROPERTY WAS GIVEN PLANNED <br />DEVELOPMENT-C (PD-C) (INDUSTRIAL PARK). THE PLANNED DEVELOPMENT <br />ZONING GIVES PLANNING AND ZONING AND CITY COUNCIL THE RIGHT TO <br />APPROVE SITE PLANS REQUIRED TO OBTAIN A BUILDING PERMIT. IF GIVEN THE <br />LIGHT INDUSTRIAL ZONING REQUESTED, PERMITS FOR FUTURE DEVELOPMENT <br />OF THE SITE FOR ANY LIGHT INDUSTRIAL USE COULD BE ISSUED AS A MATTER <br />OF RIGHT WITH ONLY STAFF APPROVAL. <br /> <br />IF COUNCIL WANTS TO ALLOW THE TOWER, MY SUGGESTION WOULD BE TO <br />CHANGE THE CITY TOWER ORDINANCE SECTION 28-104 (B) AND ALLOW THE <br />INSTALLATION OF TOWERS IN PLANNED DEVELOPMENT-C (PD-C) (INDUSTRIAL <br />PARK). THIS PROPERTY IS THE ONLY PLANNED DEVELOPMENT-C (PD-C) <br />(INDUSTRIAL PARK) ZONING LOCATED IN THE CITY LIMITS AT THIS TIME. <br /> <br />FAULK AND FOSTER IS ALSO APPEALING THE DENIAL FOR A BUILDING PERMIT <br />FOR THE TOWER THAT WAS DENIED BASED ON ZONING AND SETBACKS. THE <br />SET BACK REQUIRES THE TOWER TO BE SETBACK ON ITS OWN PROPERTY AT <br />LEAST A DISTANCE EQUAL TO THE HEIGHT OF THE TOWER. THE TOWER W~_ OULD, <br />ALSO, HAVE ENCROACHED ON PROPERTIES ON THREE OF THE FOUR SIDES THAT <br />IT WOULD BE LOCATED ON. <br /> <br />THE CITY OF PARIS CONTRACTED WITH TROUT COMMUNICATIONS TO DO A <br />STUDY OF THE FAULK AND FOSTER TOWER APPLICATION. THE FINDINGS HAVE <br />BEEN INCLUDED IN YOUR PACKET. PLEASE NOTE A TOWER IN THIS GENERAL <br />AREA IS NECESSARY TO MAKE THE CELLULAR SYSTEM OPERABLE. THERE IS <br />ALSO ANOTHER AREA THAT YOU NEED TO SEE THAT THE TOWER COULD BE <br />MOVED TO, WHICH IS GENERALLY WEST. <br /> <br />WHAT NEEDS TO BE CONSIDERED HERE IS THAT WAYNE BROWN, WHO OWNS <br />PROPERTY ACROSS THE STREET, IN THE STUDY AREA, IS ZONED PROPERLY.
