ENSEY BY DEED DATED JANUARY 13, 1995, OF RECORD IN BOOK 499, PAGE 259, LAMAR COUNTY, TEXAS REAL PROPERTY RECORDS; AND TRACT TWO IS 0.011 ACRE OF LAND PART OF THE WESLEY ASKINS SURVEY, ABST. NO. 7, AND BEING A PART OF A CALLED 41.67 ACRE TRACT OF LAND CONVEYED TO DON A. ENSEY BY DEED OF RECORD IN BOOK 499, PAGE 261, LAMAR COUNTY, TEXAS REAL PROPERTY RECORDS IN RESPONSE TO A PETITION FOR DISANNEXATION FILED BY PROPERTY OWNER CLINT SPENCER; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. Discuss and act on ORDINANCE NO. 2013 -039: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS; AMENDING SECTION 3- 3(B)(2) OF CHAPTER 3 ALCOHOLIC BEVERAGES OF THE CODE OF ORDINANCE OF THE CITY OF PARIS TO EXTEND THE ZONE PROHIBITING THE SALE OF ALCOHOLIC BEVERAGES WITHIN 1000 FEET OF ANY PUBLIC OR PRIVATE SCHOOL; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. City Attorney Kent McIlyar explained that under Section 109.33 of the Texas Alcohol Beverage Code, the Board of Trustees of a private or public school district could request the City to extend the alcohol free zone to 1000 feet. Mr. McIlyar said the Board of Trustees of the Paris Independent School District passed a resolution on September 16, 2013, requesting the City of Paris to amend its ordinance to create a 1000 foot buffer around all PISD school buildings.
