The Engineer/Project Manager will consult with the Owner <br /> and all the Owner's instructions will be issued through the <br /> Engineer/Project Manager except where the Owner reserves such right <br /> to issue instructions directly to the Contractor through other <br /> designated representatives. <br /> <br /> 4.1.2 All instructions shall be confirmed expeditiously in writing, with <br /> copies furnished the Engineer/Project Manager, the Owner's designated <br /> representatives, and the Contractor by the party issuing instructions. <br /> No instruction affecting the Engineer/Project Manager's design <br /> liability shall be issued without his prior written consent. <br /> <br /> 4.1.3 The Engineer/Project Manager shall have the authority to reject work <br /> performed by the Contractor, or to stop work on the project, if in his <br /> opinion, the requirements of the Contract are not being complied with <br /> and to order such work repeated or removed and replaced in accordance <br /> with paragraph 5.11. <br />4.2 ACCESS TO AND INSPECTION OF THE WORK: The Contractor shall provide sufficient <br />safe and proper facilities at all reasonable times for the observation and/or <br />inspection of the Work by the duly authorized representative of the Owner as <br />specified in the Contract. The Engineer/Project Manager will make periodic <br />visits to the site to familiarize himself with the progress and quality of the <br />Work, and to determine if the work is proceeding in accordance with the <br />Contract Documents. <br /> <br />4.3 SEPARATE CONTRACTS: The Owner reserves the right to award other contracts in <br /> connection with other portions of the Project under these or similar <br /> conditions of the Contract. <br /> 4.3.1 When separate contracts are awarded for different portions of the <br /> Project, "the Contractor" in the Contract Documents in each case shall <br /> be the Contractor who signs each separate Contract. This Contractor <br /> shall properly connect and coordinate his work with the work of other <br /> contractors. If any part of this Contractor's work depends for proper <br /> execution or proper results on the work of any other separate <br /> contractor, this Contractor shall inspect and promptly report in <br /> writing to the Engineer/Project Manager any discrepancies or defects <br /> he may find in such other work that render it unsuitable for such <br /> proper execution and results. Failure of this Contractor to so <br /> inspect and report shall constitute an acceptance of the other <br /> contractor's work as fit and proper to receive his work, except as to <br /> <br /> <br />
