ERI Consulting, Inc. <br /> <br />-- workmanship for one (1) year from the date of final acceptance, or use, or <br />occupancy, by the Owiler. <br /> <br />_ 11.1.1 Upon receipt of written notice from the Owner of the discovery of <br /> any defects, the Contractor shall remedy the defects and replace any <br /> property damaged therefrom occurring within the warranty and <br /> guarantee period. <br /> <br /> 11.1.2 In case of work performed by Subcontractors and where guarantees are <br />-- required, the Contractor shall secure warranties from said <br /> <br /> Subcontractors addressed to and in favor of Owner; deliver copies <br />-- of same to Engineer/Project Manager upon completion of the Work; <br />guarantee and assume full responsibility for the full period of said <br />warranties. Delivery of said guarantees shall not relieve the <br />Contractor from any obligations assumed under any other provisions <br />of the Contract. <br /> <br /> 11.1.3 This warranty and guarantee is not the exclusive remedy of the <br /> Owner, but is in addition to the general obligation of the <br /> <br />-- Contractor to faithfully perform the Contract and it in no way <br /> delimits the responsibility of the Contractor for faulty materials <br /> or workraanship. <br /> <br /> 11.1.4 Neither the final payment nor any provision of the Contract <br /> Documents shall relieve the Contractor of responsibility for faulty <br /> materials or workmanship. If the Contractor, after notice, fails <br /> to proceed promptly to comply with the terms of the warranty and <br /> <br />-- guarantee, the Owner may have the defects corrected and the <br />Contractor and his surety shall be liable for all expense incurred. <br /> <br /> ~TICLE XII. SUPPLEMEI%~T~-LAND SPECI~J~ CONDITIONS <br />_. 12.1 GENERAL: When the Work contemplated by the Owner is of such a character <br /> that the foregoing General Conditions of the Contract cannot adequately <br /> cover necessary and additional contractual relationships, the Contract may <br /> include Supplemental and Special Conditions as described below. <br /> <br /> 12.1.1 SuDDlemental Conditions <br /> <br /> May describe the standard procedures and requirements of contract <br /> <br /> administration followed by the Owner. Supplemental Conditions may <br />-- expand upon matters covered by the General Conditions, where <br /> <br /> necessary, provided the expansion does not weaken the character or <br /> intent of the General Conditions. <br /> <br /> 4/11/03 19 <br /> <br /> <br />
