TARIFF FOR GAS SERVICE TXU GAS COMPANY <br /> <br /> RATE SCHEDULE: 26 Service Rules and Regulations - Discontinuance of <br /> Gas <br /> Service <br /> <br />APPLICABLE TO: Distribution System DATE:REVISION: 0 <br />!~~ PAGE: 3 of 5 <br /> <br /> (iv) failure to pay the account of another Customer as guarantor <br /> thereof, unless Company has, in writing, the guarantee as a condition <br /> precedent to the subject Customer's service; <br /> <br /> (v) failure to pay charges arising from an under billing occurring due <br /> to any misapplication of rates more than six (6) months prior to the <br /> current billing, subject to (vi) below; <br /> <br /> (vi) failure to pay charges arising from an under billing due to any <br /> faulty metering, unless the Meter has been tampered with or unless such <br /> under billing charges are properly due; or <br /> <br /> (vii) failure to pay an estimated bill unless estimated pursuant to the <br /> provisions of these Service Regulations, or Company is unable to read <br /> the Meter due to circumstances beyond its control. <br /> <br /> (b) Company will not discontinue service to a delinquent Residential <br /> Customer permanently residing in an individually metered Dwelling Unit when <br /> that Customer affirmatively establishes, at the time the delinquency occurs, that <br /> discontinuance of service will result in some person residing at that residence <br /> becoming seriously ill or more seriously ill if the service is discontinued. A <br /> Customer seeking to avoid termination of service under this subsection must <br /> make a written request supported by a written statement from a licensed <br /> physician. Both the request and the statement must be received by Company <br /> not more than five (5) working days after the date of delinquency of the bill. The <br /> prohibition against service termination provided by this subsection shall last <br /> twenty (20) days from the date of receipt by Company of the request and <br /> statement or such lesser period as may be agreed upon by Company and the <br /> Customer. The Customer who makes such request must enter into a payment <br /> plan agreement providing for payment of the delinquent amount as well as <br /> subsequent monthly billings. <br /> <br /> (c) Except where there is a known dangerous condition or a use of Gas <br /> Service in a manner that is dangerous or unreasonably interferes with service to <br /> others, Company will not disconnect Gas Service to a delinquent Residential <br /> Customer: <br /> <br /> (i) on a day when the previous day's temperature at the approved <br /> National Weather Station for the county where the Customer takes <br /> service fell below 32 degrees Fahrenheit and the National Weather <br /> Service predicts that the temperature in that county will fall below that <br /> level during the next 24 hours; <br /> <br /> (ii) for a billing period in which Company receives a written pledge, <br /> letter of intent, purchase order, or other written notification from an <br /> energy assistance provider that it is forwarding sufficient payment to <br /> continue service; or <br /> <br /> -69- <br /> <br /> <br />
