TARIFF FOR GAS SERVICE TXU GAS COMPANY <br /> <br />RATE SCHEDULE: 26 Service Rules and Regulations - Discontinuance of Gas Service <br /> <br />APPLICABLE TO: Distribution System REVISION: 0 <br /> DATE: <br />EFFECTIVE DATE: PAGE: 4 of 5 <br /> <br /> (iii) on a day, or on a day immediately preceding a day, when <br /> personnel or agents of Company are not available for the purpose of <br /> receiving payment or making collections and reconnecting service, <br /> <br /> (4) Abandonment of Customer <br /> Company will not abandon a Residential or Commercial Customer without written <br /> approval from the appropriate Regulato~ Authority. <br /> <br /> (5) Notice <br /> In the September or October billing periods, Company will give not[ce to Residential and <br /> Commercial Customers as follows: <br /> <br /> (i) Company will provide a copy of the portion of these Service Regulations <br /> related to Discontinuance of Service to the social services agencies that <br /> distribute funds from the Low Income Home Energy Assistance Program within <br /> its service area; <br /> <br /> (ii) Company will provide a copy of the portion of these Service Regulations <br /> related to Discontinuance of Service to any other social service agency of which <br /> it is aware that provides financial assistance to Iow income Customers in its <br /> service area; and <br /> <br /> (iii) Company will provide a copy of the portion of these Service Regulations <br /> related to Discontinuance of Service to all its Residential Customers and <br /> Customers who are owners, operators, or managers of master metered systems <br /> in its service area, and will instruct owners, operators, or managers of master <br /> metered systems to provide a copy of the portion of these Service Regulations <br /> related to Discontinuance of Service to all their Customers. <br /> <br /> (6) Date of Disconnection of Gas Service <br /> Unless a dangerous condition exists, or unless Customer requests disconnection, service <br /> will not be disconnected on a day, or on a day immediately preceding a day, when <br /> personnel or agents of Company are not available to the public for the purpose of making <br /> collections and reconnecting service. <br /> <br /> (7) Company Rights and Remedies for Disconnection of Gas Service <br /> Failure of Company to discontinue Gas Service at any time after default or breach of <br /> these Service Regulations, the Rate Schedule under which Customer is receiving Gas <br /> Service, the Agreement for Gas Service, or an agreement for payment in lieu of <br /> discontinuation, or to resort to any legal remedy or its exercise of any one or more of <br /> such remedies, does not affect Company's right to resort thereafter to any one or more of <br /> such remedies for the same or any other default or breach by Customer. <br /> <br /> (8) Customer Responsibility for Restoration of Gas Service <br /> When Company discontinues Gas Service to Customer for failure in the performance of <br /> Customer under the provisions of these Service Regulations, the Rate Schedule under <br /> which Customer is receiving Gas Service, the Agreement for Gas Service, or an <br /> agreement for payment in lieu of discontinuation, before Company restores Gas Service, <br /> <br /> -70- <br /> <br /> <br />
