Regular City Council Meeting
February 9, 2004
Page 17

Evaluation, Budget Management. Councilwoman Neeley, stated again,
although there are no present problems in that area, in the future if someone
decided they could spend all they want, wouldn't that need to be in the
Evaluation. It was agreed that item would stay in the Evaluation.

Mayor Fendley reiterated that items No. One (1), No. Five (5), No. Six (6) and
No. Seven (7) under the City Judge would be deleted.

Mayor Fendley directed the Council's attention to the City Attorney's
Evaluation, which listed ten (10) items.

Councilman Guest said to delete job knowledge. It is a prerequisite for the job,
not a skill to be evaluated. All agreed.

Mayor Fendley mentioned that Communication Skills, the next item, was
important with legal council.

Mayor Fendley also thought Equity and Fairness needed to be left in the
Evaluation. He questioned if anyone thought it should be combined with
another item. Councilwoman Neeley felt it should be left in. Councilman Guest
said he didn't necessarily disagree, but that the law was the law. Councilwoman
Neeley
countered that this isn't about legal issues, but that everyone is treated the same.
Mayor Fendley said, for example, are all ordinances enforced the same for
everyone. Mayor Fendley said they would leave this in the Evaluation.

Mayor Fendley thought item No. Four (4) reverted back to item No. Three (3).
Councilman Guest agreed that it was redundant. Councilman Bell asked if they
were combining item No. Three (3) and item No. Four (4). It was agreed that
item No. Four (4) would be deleted.

Mayor Fendley moved on to No. Five (5), Conflict Resolution and there was
silence. He concluded silence says it stays in, as this would be necessary for
legal counsel.
