Regular City Council Meeting
February 9, 2004
Page 28

over from the Planning and Zoning meeting for rezoning.

Councilman Bell said he realized they couldn't reschedule the zoning issues
because of the requirement to notify everyone. He wondered if it was possible
in the initial notification to set a date for a public hearing and an alternate date,
so that wouldn't happen again.

City Attorney Schenk said he would look into it, but would be hesitant to do that
because the nature of the statute with the regard of the notice that has to be
provided.

Councilman Bell felt like this delay is economically hurting some people.
Mayor Fendley said the problem with that would be that they wouldn't know
what date to set up because there might not be a quorum again.

Councilman Bell suggested that the alternate date be an hour before the
Thursday Council meeting. Mayor Fendley said they probably wouldn't have
had a quorum on Thursday either, because they tried to set the meeting for
Friday and could not get a quorum. He indicated this is the second time this has
happened, so it was not a general rule. Mayor Fendley indicated if it got to be
a problem, then they would need to get someone on the Commission that could
show up.

There being no further business, the meeting adjourned.

ATTEST:

CURTIS FENDLEY, MAYOR

SHERIAN DIXON, ACTING CITY CLERK
