Regular City Council Meeting <br />February 9, 2004 <br />Page 4 <br /> <br />City Manager Malone indicated the next item from the Traffic Commission, <br />asking a stop sign be placed on Silverleafat Aspen Drive, stopping north and <br />south bound traffic on Silverleaf, was an action item. <br /> <br />ORDINANCE NO. 2004-006 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES OF THE <br />CITY OF PARIS BE AMENDED BY REVISING THE TRAFFIC CONTROL <br />MAP ADOPTED IN PARAGRAPH (b) OF SECTION 31-65 OF SAID CODE; <br />PROVIDING FOR A PENALTY NOT TO EXCEED $200.00; MAKING <br />OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; <br />REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN <br />CONFLICT HEREWITH; AND PROVIDING FOR AND EFFECTIVE DATE, <br />WAS PRESENTED. <br /> <br />Councilman Bell made a motion to approved the ordinance. Mayor Pro Tem <br />McCarthy seconded the motion and it carried 7 ayes, 0 nays. <br /> <br />Councilman Plata raised a question as to the scope of the Historic Preservation <br />Commission's authority. He wondered if the Commission could tell a citizen <br />what color to paint their house. Also, he wanted to know if the Commission <br />was the final authority. He indicated a lot of citizens had questions. <br /> <br />City Attorney Schenk related that there was a process to appeal a decision by <br />the Historic Preservation Commission. People could appeal a denial to the City <br />Council. The citizen, first, has to go before the Commission to get a Certificate <br />of Appropriateness. When denied, they can appeal that decision to the Council. <br />City Attorney Schenk said there was not a need for a Certificate of <br />Appropriateness if they are repainting and not changing the color, but a color <br />change or any exterior change requires the Certificate. <br /> <br />Mayor Fendley said this is like any other new committee; it will take a while to <br />get the information out to the public.
