paths. No use shall imitate airport lighting or impede the ability of pilots to <br />distinguish between airport lighting and other lighting. <br />b. Glare <br />No glare producing material, including but not limited to unpainted metal or <br />reflective glass, shall be used on the exterior of structures located within airport <br />approach and landing paths or on nearby lands where glare could impede a pilot's <br />vision. <br />c. Industrial Emissions <br />No agricultural, industrial, mining or similar use, or expansion of an existing <br />agricultural, industrial, mining, or similar use, shall, as part of its regular <br />operations, cause emissions of smoke, dust, or steam that could obscure visibility <br />of pilots, except upon demonstration, supported by substantial evidence, that <br />mitigation measures imposed as approved conditions will reduce the potential for <br />safety risk or incompatibility with airport operations to an insignificant level. The <br />review authority shall impose such conditions as necessary to ensure that the use <br />does not obscure visibility. <br />d. Communications Facilities and Electrical Interference <br />1. No use shall cause or create electrical interference with navigational signals or <br />radio communications operated on the airport or operated between an airport <br />and aircraft. Proposals for the location of new or expanded radio, radio- <br />telephone, and television transmission facilities and electrical transmission <br />lines shall be coordinated with FAA prior to approval. <br />Approval of cellular and other telephone or radio communication towers on <br />leased property located within an airport land use compatibility zone <br />established according to Section 6 (A) of this Ordinance, shall be conditioned <br />to require their removal within 90 days following the expiration of the lease <br />agreement. A bond or other security shall be required to ensure this result. <br />Proof of as— constructed height shall be required by the approving body to <br />ensure the construction of the structure was done in compliance with the <br />submitted plans and does not exceed the heights as noted in Section 5. <br />e. Water Impoundments and Wildlife Attractants <br />1. Any use or activity that would result in the establishment or expansion of a <br />water impoundment shall comply with the requirements of this subsection. <br />This subsection shall not apply to: <br />a. Stormwater management basins established by an airport. <br />b. Seaplane landing areas within an airport. <br />c. Wetland mitigation, creation, enhancement, or restoration projects located <br />outside the five subzones, provided they are located, designed, and <br />maintained in perpetuity to avoid creating a wildlife hazard or increasing <br />hazardous movements of birds across runways or in approach and <br />departure paths. <br />18 <br />
