2. No new or expanded water impoundments of one — quarter (1/4) acre in size or <br />larger are permitted: <br />a. Within any of the five subzones and within 5,000 feet from the end or <br />edge of a runway, whichever is greater; or <br />b. On land owned by the airport sponsor that is necessary for airport <br />operations. <br />3. The establishment of a new water impoundment one —quarter (1/4) acre in size <br />or larger within any of the five subzones is allowed only with the prior <br />approval of an airport zoning permit and subject to the following conditions: <br />a. The City Council of the City of Paris, Texas, shall be the final decision — <br />making body on the airport zoning permit application rather than the <br />Planning Manager. <br />b. Prior to filing its application, the applicant shall coordinate with the <br />airport sponsor, and the FAA regarding the proposed water impoundment <br />and its short and long —term potential to significantly increase hazardous <br />movements of birds feeding, watering, or roosting in areas across runways <br />or airport approach and departure paths and proposed mitigation. As <br />reasonably necessary to determine the potential for significant bird strike <br />hazards, the applicant may be required to submit a bird strike study for <br />these agencies review and comment. <br />c. An application for an airport zoning permit according to Section 11 shall <br />not be deemed complete for review purposes until the applicant has filed <br />with the City of Paris a final bird strike study, as applicable, addressing <br />comments from agencies as listed in subsection b. above. If a bird strike <br />study was not required, an application for an airport zoning permit shall <br />not be deemed complete until the applicant submits correspondence or <br />other sufficient proof demonstrating agreement among the agencies that <br />no bird strike study is required and no unmitigated significant bird strike <br />hazard will result from approval of the permit. <br />d. In addition to the review criteria stated in Section 11, the Paris City <br />Council shall approve an airport zoning permit for a new water <br />impoundment only if it makes all of the following findings: <br />i. The proposed water impoundment, taking into consideration any <br />proposed or recommended mitigation measures, will not <br />significantly increase the risk of bird strike hazards to air <br />navigation. <br />ii. Proposed mitigation measures are based on accepted technology <br />and industry practices, and have been demonstrated to be <br />effective, reliable over time, and affordable to implement. <br />iii. The applicant has demonstrated an ability to pay for necessary <br />short—term and long —term mitigation measures, and to ensure the <br />M] <br />
