Tax <br />Abatement Agreement. <br />• Section 551.087 of the Texas Government Code, (1) to discuss or deliberate <br />regarding commercial or financial information that the governmental body has <br />received from a business prospect that the governmental body seeks to have <br />locate, stay, or expand in or near the territory of the governmental body and with <br />which the governmental body is conducting economic development negotiations; <br />or (2) to deliberate the offer of a financial or other incentive to a business prospect <br />described by Subdivision (1). <br />Mayor Frierson convened City Council into executive session at 7:13 p.m. <br />27. Reconvene into open session and possibly take action on those matters discussed in <br />Executive Session. <br />Mayor Frierson reconvened City Council into open session at 7:48 p.m. and said they <br />discussed the incentive agreement with Paris Warehouse 107. He said the tax abatement <br />committee had been discussing the compliance issues for a period of weeks and it had been <br />determined for one year out of that agreement the incentive fell slightly short in terms of the <br />number of jobs created. Mayor Frierson said it was up to the Council to direct the city manager <br />or city attorney if there was any action to take in regard to the non - compliance issue. Council <br />Member Hashmi said the Council could ask for the return of seven years of the tax abatement. <br />He also said it was the advice of the attorney, as done in other cities who do not like to penalize <br />and look business unfriendly, that they request the return of the tax abatement for the one year <br />they were not in compliance for job creation. <br />A Motion to request Paris Warehouse 107 to pay back the money for 2012 for non- <br />compliance was made by Council Member Hashmi and seconded by Council Member Lancaster. <br />Motion carried, 7 ayes — 0 nays. <br />Mayor Frierson confirmed with the City Attorney that a demand letter would be sent to <br />the company. <br />23. Discuss and act on amendments to the Personnel Policies and Procedures Handbook. <br />Mr. Godwin said the amendments included two existing policies that needed to be <br />clarified and one new policy concerning weapons in the workplace. He said that the drug policy <br />needed to be changed so that anyone who tested below the legal limit but above a detectable <br />level on a drug test is placed on administrative leave without pay. Mr. Godwin recommended <br />that the attendance day policy be clarified to state that absences due to a disciplinary action <br />would not prevent the earning of an attendance day. He also recommended a restriction against <br />guns and certain large knives in the workplace. Council Member Hashmi requested that <br />employees also be paid while on administrative leave if on the second reading there is a false <br />
