MINUTES BOARD OF ADJUSTMENT WEDNESDAY, APRIL 12, 1978 10:00 O'CLOCK A. M. COUNCIL ROOM - CITY HALL PARIS, TEXAS The Board of Adjustment of the City of Paris met in a called meeting, Wednesday, April 12, 1978 with the following members present: 1. F. D. Mallory, III - Chairman 4. Richard Nafe 2. Dee Cunningham 5. Charlie Walker 3. Herschel McKinney 6. John Williams, Jr. Chairman Mallory called the meeting to order and the Minutes of November 30, 1977 were approved as presented. The Board took up the petition of Mr. D. B. Cunningham for a variance to Section 9- 601(1) of the Zoning Ordinance on Lot 11, City Block 43 located at 118 4th N.W. Mr. Cunningham was present saying he wished to construct a 12'x22' open carport on the south side of his residence which would be on the property line instead of being set back 5 feet from the property line as required by ordinance. He stated this location was available to the front of his house, would shelter two small cars, would not change the drainage of water and he had no objection from the neighbor most affected, Mr. Lloyd Herron. He went on to say that to build it in the back yard would defeat his purpose for having it and require the moving of a fence. Mr. Nafe asked about the distance to the next house jouth and Mr. Cunningham replied that it was approximately 15 feet from his property line. Mr. McKinney stated there were numerous existing structures in this area and around the City which do not conform to the ordinance. There was no one else present to speak concerning the matter and following discussion Mr. Williams made a motion to approve the variance. Mr. Nafe seconded the motion based on the statement that the next door neighbor did not object. Chairman Mallory called for the vote and the motion carried unanimously.
