MINUTES OF THE <br />BOARD OF ADJUSTMENT <br />DECEMBER 1, 1986 <br />The Board of Adjustment of the City of Paris met in a called meeting Monday, <br />December 1, 1986, at 5:00 P.M. in the Council Room, City Hall, Paris, Texas. <br />Members present were F.D. Mallory III, Chairman, Richard Nafe, J.P. Shull, <br />John Williams, Jr., and Alec Woods. Also present was Joe McCollum, Director <br />of Community Development. <br />Chairman Mallory called the meeting to order and the minutes of the last <br />meeting were approved as presented. <br />The public hearing was opened on the petition of St. Joseph's Hospital for <br />a variance to Section 9 -502 (3) of the Zoning Ordinance relative to fence <br />height requirements in the front yard on Lots 7,8,9,10, 12, and 13, Block <br />4, Felts, Fort and Varner Addition located on the southeast corner of E. <br />Austin Street and 10th S.E. <br />David Jackson and Felix Gibson represented the hospital and Mr. Jackson told <br />the Board that due to vandalism and theft to employee's vehicles on this <br />parking lot, a six (6) foot high chain link fence had been erected along <br />10th S.E. and Austin Street. He indicated that they thought they were in <br />compliance with the ordinance but upon notification of the violation they <br />submitted a request for a variance to the 40 inch height limitation in the <br />20 foot front yard along 10th S.E. <br />Mrs. Ruth Marr, 405 S.E. 10th, voiced opposition to the fence saying that <br />it created a hazard in backing out of her driveway. She pointed out that <br />when the wood fence along her north property line was installed by the <br />Hospital, the part in front of her house had to be no more than 40 inches <br />high to permit sight clearance. <br />Mr. Williams asked Mrs..Marr if the fence were moved back for 25 feet or so <br />next to her house, would that remove the hazard and satisfy her objection. <br />Mrs. Marr indicated that this was possible and Mr. Gibson agreed to relocate <br />the fence adjacent to her house to a point that would remove the hazard and <br />still serve their purpose of protecting employees vehicles from vandals. <br />The public hearing was closed and after discussion by the Board, a motion <br />was made by Mr. Nafe, seconded by Mr. Shull to allow the variance subject <br />to an adjustment of the fence along 10th S.E. to relieve the hazard. The <br />adjusted location to be to mutual satisfaction of Mrs. Marr and the Hospital <br />and verified by Mr. McCollum. The motion carried 5 ayes, 0 nays. <br />Chairman Mallory opened the Public Hearing.on the petition of Brooks Armstrong <br />for a variance to Section 9 -501 (1) of the Zoning Ordinance relative to front <br />yard requirements on Lot 16, City Block 222 -A located on the southwest corner <br />of 25th N.E. and E. Price Street. <br />
