MINUTES OF THE <br />BOARD OF ADJUSTMENT <br />MAY 4, 1988 <br />The Board of Adjustment of the City of Paris met in a called meeting, <br />Wednesday, May 4, 1988, at 5:15 P.M. in the Conference Room, City Hall <br />Annex, 150 S.E. 1st St., Paris, Texas with the following members <br />present: <br />1. F.D. Mallory, III, Chairman <br />2. Bill Lightfoot <br />3. Richard Nafe <br />4. J.P. Shull <br />Also present were T.K. Haynes, City Attorney and Joe McCollum, Director <br />of Community Development. <br />Chairman Mallory called the meeting to order and opened the public <br />hearing on the petition of Mrs. Clarence Smith for a variance to <br />Section 9 -501 (1) of the City of Paris Zoning Ordinance relative to <br />front yard requirements on Lot 6, Block F, Johnson Woods Estates, <br />located at 2895 Mahaffey. <br />Mrs. Smith told the Board that she just wanted a carport to protect her <br />car and felt it would not hurt the neighborhood. <br />Mr. L.O. Rucker, Mr. and Mrs. Joe Julian and Mr. John Wickes, area <br />residents, were present in support of the request. <br />Mr. Rucker stated the Smith house was always kept neat in appearance. <br />Felix McDowell, contractor, showed the Board pictures of the proposed <br />carport. <br />Chairman Mallory requested City Attorney Haynes explain his memorandum <br />to them concerning authority and jurisdiction in the matter. <br />Mr. Haynes reviewed from the Zoning Ordinance the areas of jurisdiction <br />of the Board of Adjustment and advised that they could only vary yard <br />requirements in instances where an irregular lot shape, slope or other <br />unusual condition makes it impossible to develop the property in same <br />manner as other properties in the area. <br />He went on to say that to allow Mrs. Smith's carport, the subdivision <br />plat of Johnson Woods Estates would have to have the building line <br />changed through the exception procedure of the Subdivision Regulations <br />with approval by the Planning and Zoning Commission and the City <br />Council. <br />Other discussion was held and Mr. Lightfood made a motion to adjourn <br />the meeting based on the statement of the City Attorney that the Board <br />had no jurisdiction in the matter.
