MINUTES OF THE BOARD OF ADJUSTMENT <br />CITY OF PARIS, PARIS, TEXAS <br />June 4, 1974 <br />The Board of Adjustment met at 9:00 o'clock A.M., June 4, 1974, in the City- <br />Council %Qm, City Hall, Paris, Texas. Alternate Chairman Mallory called <br />the Board Meeting into session with the following members present: F. D. <br />Mallory, !!I, Dr. James M. Brunette, names Farris, and Charles Adkins. <br />Chainnan Mallory stated the meeting was called K hear the request of Mr. <br />J. W. Vi visor as an appeai from the decision of the Building Inspector with <br />a request for exception and variance to the terms of the Zoning Ordinance, <br />Section 13-101, Section Q so as to the construction of a building <br />extending a maximum of 6 feet 2 inches into an existing utility and drainage <br />easement and that said building be allowed to be placed more near than 3 feet <br />?rcm said easement line, and that said Auilding be allowed to be placed within <br />2 feet 7 inches of an existing sewer line. <br />During tNe discussion of this matter, it was pointed out that the easement <br />adjacent to the south side of Lot 11, Block A, Johnson Woods Addition - 560 <br />S.E. 31st Street was originally an extension of Allen Street and that in 1971 <br />the street had* been abandoned by the City of Paris with Quit Claim Deeds to <br />the abutting roperty owners. <br />During the discussion of this matter, Mr. Harrison's letter of application <br />Vated May 22, 074 was read by the City Manager in which Mr. Harrison agreed <br />that he would provide any instruments necessary, holding the city harmless <br />for any damage done to his garage as a result of work done in the easement. <br />The letter of application also stated that Mr. Harrison planned tv construct <br />cpncrete drainage flumes from the existing pavement back to the creek K handle <br />the drainage. A?ter discussion Mr. Farris moved, Mr. Adkins seconded the motion, <br />as requested subject to the execution of necessary agree- <br />mnents providing release of the City of Paris from any and all liability that <br />might occur as a result of work done in the easement. The motion carried <br />unanimously. After the motion was passed Mr. Harrison agreed that all drainage <br />work and construction of the flameswould be his responsibility and any question <br />Df sizing or flooding as a result of this would be borne by the applicant, Mr. <br />__gin W. Harrison. <br />There being no furthor business to come before the Board of Adjustment Mr. <br />Farris moved, and Dr. Brunette seconded, that the meeting be adjourned.
