MINUTES OF THE BOARD OF ADJUSTiMENT <br />CITY OF PARIS, TEXAS <br />AUGUST 29, 1971 <br />The Goard of Adjustment met at 5 :25 P.M., August 29, 1974, in the City <br />Council Room, City hall, Paris, Texas. Alternate Chairman Mallory called <br />the [;oayvi Meeting into session with the following members present: F. D. <br />Mallory, III, Dr. ,lames Brunette, Charlie Adkins and Ben Hinds. In the <br />absence of Secretary Westfall, Joe McCollum, Director of Community Develop - <br />ment was called upon to take minutes of the meeting. <br />The first order of business was to select a permanent Chairman due to the <br />resignation of Dr. Felty. Dr. Brunette nominated F. D. Mallory for Chairman. <br />Mr. Adkins seconded the non4nation. There were no other nominations. The <br />vote was upanimous for Par. '�allory. <br />The petition of Mr. Jfim Moore as an appeal from the decision of the Building <br />Inspector with a request for exception and variance to the Zoning Ordinance, <br />Section 9, Sub - sections 101, 201, 301, 401, 501 and 501 can Lot B, Block 75-A <br />fronting on Provine Alley was taken up at this time. <br />T. Y. [Jaynes, City Attorney, reviewed the case stating that the house was <br />constr uLted on the lent without penRits and was accidently discovered by the <br />6uildinn inspector. The Ji-d Waltcr Homes, builder of the house, was told <br />to find another lot of suf icient size and mnove the house. It being? impossible <br />inn-de mov /e\ the Board. <br /><d4u-:. to the narrow width of Provine Alley, an appeal was <br />nn-dee t� Vie- Board. <br />Jim N. Thomposn, representing Jim Walter Homes builder and Almeta Maxey, owner <br />of the house, presented a sketch indicating the house to have a front yard of <br />15 feet and side yards of 2.5 feet. Fie stated that the builder made the mis- <br />take % not taking out permits, but to move the house would cause financial <br />hardship to the owner. <br />PFotographs of the house and lot were reviewed by the Beard. Jae McCollum <br />stated he and the Fire [iarshall had inspected the property and had taken the <br />photographs. lie said the house was in line with the Existing houses and there <br />was roo:is between houses to get to the back. <br />During discussion of the natter it was pointed out that the house is being <br />loved in without utilities and unfinished inside. The variances, if approved, <br />would allow the house to be finished and utilities connected. <br />Mr. Adkins made a motion "Co approve the request subject to the following: <br />1. Builder will secure proper permits as required by Ordinance <br />2. The house, when completed, shall meet the requirements of the <br />Building Code. <br />ter. Hinds seconded the motion and all members voted aye. <br />There being no further business to come before the Board of Adjustment, Dr. <br />Brunette proved and Mr. Adkins seconded, that the meeting be adjourned.
