May 9, 1975 <br />MEMORANDUM <br />TO : BOARD OF ADJUSTMENT <br />FROM : DIRECTOR OF COMMUNITY DEVELOPMENT <br />SUBJECT: AGENDA ITEMS FOR MAY 14, 1975 <br />1. 0. L. Rainey: You will remember from our last meeting that an 18 lot <br />subdivision was planned by Mr. Rainey on this narrow strip of land. Ten <br />lots could not be platted with 100' minimum depth lots. <br />The Planning and Zoning Commission denied the preliminary plat at their <br />meeting May 5, 1975 due to the substandard depth lots and the appeal from <br />that decision is being made to you. <br />In his appeal, Mr. Rainey is requesting a variance to allow a lot depth of <br />86.5 feet subject to the acceptance and approval of restrictions which he is <br />willing to have placed on him. A copy of the proposed restrictions is attached. <br />It is a difficult property to develop as presently zoned due to limited <br />access to dedicated streets. If the property is to ever be used for single <br />family homes, Mr. Rainey's proposal seems to be a logical way to do it. <br />2. Tommy Clem: This request involves a carport which bas been built on the <br />front of the house located at 2460 Ballard Drive. The construction, <br />which is almost 100% complete, was done without a Building Permit. <br />It was brought to the attention of the Building Inspector who advised the <br />contractor of the violation. The owner requested a permit for the job but <br />the permit was denied due to violation of the 25 foot front yard set back <br />requirement. At its closest point, the carport is 11 feet from the property <br />line. <br />If the variance is granted, a permit would be issued and completion of the <br />construction could be done. <br />If the variance is disallowed, the carport would have to be removed or cut <br />back to comply with the Ordinance. <br />Thank you <br />Joe N.
