C. <br />MINUTES OF THE BOARD OF ADJUSTMENT <br />CITY OF PARIS_, TEXAS <br />Jt1IY 1, 1975 <br />The Board of Adjustment of the City of Paris met in a called meeting, <br />Tuesday, July 1, 1975, at 5:15 P.M. in the Council Room of City Hail with <br />the following members present: <br />1. F. D. Mallory, III - Chairman <br />2. Ben Hinds <br />3. Richard Nafe <br />4. Charlie Walker <br />The meeting was called to order by Chairman Mallory and the Minutes of May <br />14, 1975 were approved on a motion by Mr. Walker, seconded by Mr. Hinds. <br />The only item on the Agenda was the petition of Franchise Realty Interstate <br />Corporation for a variance to Zoning Ordinance No. 1710, Section 9 -502 (4), <br />Yard Requirements on Lots 1 and 2, City Block 32 -D located at 1215 Lamar <br />Avenue. <br />Joe McCollum, Director of Community Development, reviewed the circumstances <br />which resulted in the petition being filed. He stated that a Building Permit <br />had been issued for the McDonald's Restaurant at this location and a brick <br />trash enclosure had been erected on the corner of E. Houston Street and <br />12th N.E. which obstructs the view of traffic. Although it was indicated <br />on the Site Plan, the significance of the location of the enclosure and <br />its height (approximately 7 feet) was overlooked when plans were reviewed. <br />Section 9 -502 (4) would require a 20 foot set back off of Houston Street <br />for yard requirements. The enclosure sets 5 feet off of Houston Street at <br />this time. <br />In a letter to Mr. Napper, dated June 18, 1975, Mr. McCollum had stated the <br />City's position in the matter and had directed McDonald's to make the enclo- <br />sure conform to the Zoning Ordinance by reducing the height of the enclosure <br />wall to no higher than 30" above the general ground level or to demolish <br />the present enclosure which could be relocated in a similar area on the <br />east side of the property. <br />Mr. Roger Napper, representing the petition, stated that he felt the variance <br />should be granted and the enclosure allowed to remain where it is because <br />the plans were approved that way by the City. The enclosure could have <br />been moved to another location prior to construction had it been required. <br />He felt the City had ample time to catch the mistake on the plans before it., <br />was built. it would do no good to lower the wall of the enclosure to 30" <br />above ground as it would not hide the trash container that goes in it. <br />Present in the audience were Mr. J. B. Bristow, Mrs. Hamp Fagan, R. L. <br />Smith, Howard Simmons and Lyda Lewis, all residents in the immediate area, <br />who stated the enclosure created a blind corner and would be hazardous. <br />They also were concerned about possible odors from the trash enclosure. <br />
