W. and <br />Maple Avenue. Councilwoman Smith seconded the motion which carried 7 <br />ayes, 0 nays. <br />Mrs. W. M. Ball, 3280 Margaret Street appeared before the Council <br />requesting the enforcement of front yard requirements of the Zoning <br />Ordinance. She said she had hired a contractor, Robert Ray, to build a <br />carport in front of her house not realizing it was unlawful to do so, <br />and had been placed on notice to remove it by the City. She said there <br />were numerous others around the City in violation, if her was. <br />Thomas J. Melton, 3290 Margaret Street, addressed the Council on the <br />same subject saying that he had also been placed on notice to remove <br />his carport. He said he had ask his neighbors if they objected to one <br />being built and received no objections. Mr. Melton said he too was not <br />aware of the requirements for a building permit and questioned how <br />similar carports in the City had been put up. <br />In Council discussion, it was pointed out that there was no relief <br />available to the properties involved and Mayor Fisher stated that other <br />similar nonconforming structures would be investigated and required to <br />be taken down if necessary. <br />City Attorney Haynes stated that correction should be done within the <br />time limit given in the notices mailed to the owners. If not, the <br />violation would be processed through the Municipal Court. <br />City Manager Malone announced the next item was consideration of and _ <br />action on authorizing the preparation of an ordinance revising Section <br />3 -3 (2) of the Code of ordinances allowing alcoholic beverages to be <br />served at the Fairgrounds if a permit is issued by the State of Texas. <br />Jay McCollum, 2455 Briarwood, spoke against the amendment citing rise <br />in statistics such as DWI and public display associated with alcohol <br />consumption. He also said that it would tend to increase taxpayers <br />expense for extra police control, etc., and could lead to the <br />availability of such beverage on other public property. <br />Mayor Fisher stated his support of the amendment saying it would afford <br />the City more control over the use of alcohol. <br />City Attorney Haynes read the ordinance as currently written. <br />Randall Scott, Pastor of Immanual Baptist Church, Dwight Blankenship, <br />Pastor of First Baptist Church, Dave Philley, 336 E. Polk, J. T. <br />Shipman, 3355 E Houston and Gerald Whitesides, each presented their <br />reasons for opposing the change and asked the Council to enforce the <br />ordinance as it presently exits <br />Following discussion, a mot -ion was made by Councilman Bell, seconded by <br />Councilman Booth to authorize preparation of the ordinance.
