MINUTES OF THE PLANNING AND ZONING COMMISSION FEBRUARY 1, 1988 The Planning and Zoning Commission of the City of Paris met in regular session Monday, February 1, 1988 at 7:00 P.M. in the Council Room, City Hall, Paris, Texas with the following members present: 1. Freddy Swaim, Chairman 5. Jacob Hildreth 2. Ozie Battle 6. Bruce McMonigle 3. Charles Christian 7. Ronnie Nutt 4. Bill Davidson 8. Kyle Perry Also present were T.K. Haynes, City Attorney, Earl Smith, City Engineer, and Joe McCollum, Director of Community Development. Chairman Swaim opened the meeting and the minutes of January 4, 1988 were approved as presented. Chairman declared the public hearing open on the petition of G.L. Skidmore for a change in zoning from an Agricultural District (A) to a Commercial District (C) on Lots 2 -A and 4, City Block 321 located on the south side of Spur Hwy. 138 between Loop 286 and F.M. 195. Scott McDowell, attorney, appeared representing Mr. Skidmore. He pointed out that Mr. Skidmore had purchased Lot 2 -A, where his building is located, in 1977 prior to being annexed by the City. Lot 4 was purchased in 1984 and he expanded parking facilities for his trucks on that tract. He went on to say that the lots were adjacent to existing Commercial zoning and uses. Vic Ressler, owner of property south of the Skidmore building said he did not object to the zoning request but wished to go on record as being concerned about the 42" drainage pipe installed by Mr. Skidmore between his mini storage facility and Spur 138. He said he had installed a 48" pipe on his property which was not carrying storm water adequately and he feared more flooding of his building. No one else spoke and the public hearing was closed. A motion was made by Mr. Perry, seconded by Mr. McMonigle, to recommend approval of the change. The motion carried 7 ayes, 0 nays. Chairman Swaim declared the public hearing open on the petition of James Patterson for a Site Plan Approval in a Planned Development - Retail District (PD -a) on Lot 17, City Block 296, located at 3355 Lamar Avenue. Mr. Patterson and his consulting engineer reviewed the proposed Site Plan for an Arby's Restaurant and stated that additional drainage study had been done and the drainage portion had been revised. Earl Smith, City Engineer, stated he had not reviewed the new plan but had told the consultant that he felt a proper solution could be worked out. Several persons were present in opposition to the Site Plan as presented: Rod Kosterman, 3360 E. Houston and Steve Elkins, 3380 E.
