3 <br />f <br />City Attorney Haynes explained that it is his understanding of the <br />obligation under the laws of the state of Texas for every person to <br />accept the drainage water that comes to them, and discharges it in a <br />manner that does not harm the downstream person in anyway that is not <br />already occurring before they do it. Mr. Haynes said it was his <br />understanding Arby's would be putting the water into Lamar Ave. <br />No one else appeared before the Council, and the public hearing was <br />declared closed. <br />After discussion, a motion was made by Councilman Clifford, seconded by <br />Councilman Kent approving the site plan as passed by the Planning and <br />Zoning Commission subject to the exceptions of the City Engineer, and <br />called for the preparation of an Ordinance to be presented at the next <br />regular council meeting. The motion carried 6 ayes, 0 nays. <br />Mayor Burnett declared the public hearing open on the petition of Sid <br />Hollingsworth for Site Plan approval in a Planned Development - Retail <br />District (PD -a) on Lot 11, City Block 296, located at 3235 Lamar Ave. <br />Mayor Burnett called for proponents to appear, and Mr. Sid <br />Hollingsworth appeared in his behalf requesting approval of the site <br />plan. <br />Mayor Burnett called for opponents to appear, none appeared, and the <br />public hearing was declared closed. <br />A motion was made by Councilman Fendley, seconded by Councilman Wortham <br />for approval of the site plan, and called for preparation of an <br />Ordinance to be presented at the next regular council meeting. The <br />motion carried 6 ayes, 0 nays. <br />Mayor Burnett announced that no action was required on item number five. <br />Joe McCollum, Director of Community Development, presented the replat <br />of part of Lots 2 and 3, City Block 313. <br />A motion was made by Councilman Fendley, seconded by Councilman <br />Clifford for approval of the replat subject to the requirements of the <br />City Engineer. The motion carried 6 ayes, 0 nays. <br />City Attorney Haynes presented the following petitions for rezoning: <br />Sid Hollingsworth, part of Lot 18, City Block 296 Site Plan approval in <br />a Planned Development Retail District; Weldon Houchins, Lots 14A and <br />19, City Block 70C from an Agricultural District to Commercial District. <br />Mayor Burnett referred the petitions to the Planning and Zoning <br />Commission for their study and recommendations and called for a public <br />hearing at the next regular Council meeting. <br />There being no further business, the meeting adjourned. <br />
