3 f City Attorney Haynes explained that it is his understanding of the obligation under the laws of the state of Texas for every person to accept the drainage water that comes to them, and discharges it in a manner that does not harm the downstream person in anyway that is not already occurring before they do it. Mr. Haynes said it was his understanding Arby's would be putting the water into Lamar Ave. No one else appeared before the Council, and the public hearing was declared closed. After discussion, a motion was made by Councilman Clifford, seconded by Councilman Kent approving the site plan as passed by the Planning and Zoning Commission subject to the exceptions of the City Engineer, and called for the preparation of an Ordinance to be presented at the next regular council meeting. The motion carried 6 ayes, 0 nays. Mayor Burnett declared the public hearing open on the petition of Sid Hollingsworth for Site Plan approval in a Planned Development - Retail District (PD -a) on Lot 11, City Block 296, located at 3235 Lamar Ave. Mayor Burnett called for proponents to appear, and Mr. Sid Hollingsworth appeared in his behalf requesting approval of the site plan. Mayor Burnett called for opponents to appear, none appeared, and the public hearing was declared closed. A motion was made by Councilman Fendley, seconded by Councilman Wortham for approval of the site plan, and called for preparation of an Ordinance to be presented at the next regular council meeting. The motion carried 6 ayes, 0 nays. Mayor Burnett announced that no action was required on item number five. Joe McCollum, Director of Community Development, presented the replat of part of Lots 2 and 3, City Block 313. A motion was made by Councilman Fendley, seconded by Councilman Clifford for approval of the replat subject to the requirements of the City Engineer. The motion carried 6 ayes, 0 nays. City Attorney Haynes presented the following petitions for rezoning: Sid Hollingsworth, part of Lot 18, City Block 296 Site Plan approval in a Planned Development Retail District; Weldon Houchins, Lots 14A and 19, City Block 70C from an Agricultural District to Commercial District. Mayor Burnett referred the petitions to the Planning and Zoning Commission for their study and recommendations and called for a public hearing at the next regular Council meeting. There being no further business, the meeting adjourned.
