15 <br />MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL <br />March 10, 1988 <br />The City Council of the City of Paris met in regular session, Thursday, <br />March 10, 1988, 5:15 P. M., Council Room, City Hall, Paris, Texas. <br />Mayor Billy Joe Burnett called the meeting to order with the following <br />Councilmen present: Bill Bone, Eric Clifford, Curtis Fendley, Travis <br />Wortham, and Marshall H. Kent, Jr. Also present was City Manager, <br />Michael E. Malone, City Attorney, T. K. Haynes, and City Clerk, Mattie <br />Cunningham. <br />Joe McCollum, Director of Community Development, appeared before the <br />Council and presented the minutes of the , Planning and Zoning <br />Commission's meeting held on March 7, 1988, and attached hereto as part <br />of these minutes as exhibit A. <br />Mayor Burnett announced the first order of business would be <br />continuation of the public hearing on the petition of Charlie Patterson <br />for Site Plan approval in a Planned Development- Retail District (PD -a) <br />on Lot 17, City Block 296, located at 3355 Lamar Avenue. <br />Mayor Burnett called for proponents to appear, and Brad Hutchison, <br />Attorney with the firm of McLaughlin, Hutchison, and Hunt, appeared <br />before the Council representing John. Miles owner of the property and <br />speaking in behalf of the petitioner, Arby's Restaurant. Mr. Hutchison <br />advised that at the first Planning and Zoning Commission's meeting <br />regarding this matter, there were 12 items adjacent property owners <br />objected to. Arby's went back and revised their site plan, and eight <br />of those objections have been completed, two have substantially been <br />met. Arby's was not willing to move the trash container close to the <br />restaurant, and the owner was not willing to be restricted as to the <br />use of the 60 foot buffer zone between the residential area, and the <br />Arby's Restaurant. Mr. Hutchison requested the site plan be approved <br />as amended. <br />Mayor Burnett called for opponents to appear, and Steve Elkins, 3380 E. <br />Houston Street, appeared before the Council requesting the eight foot <br />fence along the northeast boundary line adjacent to the buffer zone <br />which is a view area of his backyard be extended, and requested that <br />all fences be constructed prior to any construction. Mr. Elkins also <br />stated that he was concerned with the trash container being <br />approximately 60 feet from his driveway. <br />Rod Kosterman, 3360 E. Houston Street, appeared before the Council <br />stating that a 10 foot fence on the east and west boundaries of the <br />buffer zone was requested at the Planning and Zoning Commission's <br />meeting, not just the north boundary. A major concern of Mr. Kostermar <br />is the drainage and drainage ditch stating it sould be a concrete <br />ditch instead of a dirt or grass ditch. Mr. Kosterman requested that <br />it be defined in the buffer zone that there would not be a picnic or <br />playground area, and requested notification prior to this being <br />installed. Mr. Kosterman also requested the fence be installed prior <br />to construction. <br />
