�c �0 <br />1 7 <br />MINUTES OF THE <br />PLANNING AND ZONING COMMISSION <br />MARCH 7, 1988 <br />The Planning and Zoning Commission of the City of Paris met Monday, March 7, <br />1988 at 7:00 P. M. in the Council Room, City Hall, Paris, Texas with the <br />following members present: <br />1. Charles Christian <br />2. Bill Davidson <br />3. Jacob Hildreth <br />4. Bruce McMonigle <br />5. Ronnie Nutt <br />6. Kyle Perry <br />Also present were T. K. Haynes, City Attorney and Joe Mc Collum, Director of <br />Community Development. <br />Ronnie Nutt served as Chairman in the absence of Freddy Swaim and called the <br />meeting to order. <br />Chairman Nutt announced the public hearing would continue on the petition of <br />Charlie Patterson for Site Plan approval in a Planned Development- Retail District <br />(PD -a) on Lot 17, City Block 296, located at 3355 Lamar Avenue. <br />Brad Hutchison, Attorney, spoke for the petition and reviewed the 12 items <br />addressed by persons opposing the Site Plan at the February meeting. He <br />stated that 8 of the objections had been completely met and 2 others had been <br />substantially met. On the matter of the location of the trash container, the <br />owner was not willing to move it closer to the restaurant building. The owner <br />also was not willing to be restricted as to use of the 60 foot buffer zone bet- <br />ween the residential area and the Arby's building. <br />Mr. Hutchison concluded by saying that Dr. Miles and the applicant had indicated <br />their willingness to offer protection to the adjacent residential district by <br />the changes made and he requested a recommendation of approval of the request. <br />Rod Kosterman, 3360 E. Houston, thanked the applicant for the changes made to <br />the Site Plan, but stated he felt that drainage had still not been properly <br />addressed. He again requested that no picnic or playground use be made of the <br />60 foot buffer area and requested that the construction of a 10 foot wood fence <br />also be required along the east and west property lines adjacent to the buffer <br />zone. He asked that the fence be built prior to building construction. <br />E. T. Fushion, 3365 E. Houston, spoke about drainage saying that according to <br />measurements he and other neighbors made on the site, the contours and elevations <br />shown on the plan were in error. He felt an oversight had been made by the <br />applicant's engineer and the drainage plan would not work. <br />Mitchell Graves, 3340 E. Houston, voiced his appreciation for the concern shown <br />by Arby's and after assurance was given on the drainage plan he stated he had <br />no objection. <br />Steve Elkins, 3380 E. Houston, requested an 8 foot fence along the east boundary <br />line adjacent to the buffer zone and also argued for relocation of the trash <br />container. <br />
