�36 r RESOLUTION NO. 87 -049 WHEREAS, the City Council of the City of Paris did heretofore, in Resolution No. 86 -001, award the contract for construction of Additions to Water Treatment Plant to Heritage Constructor's, Inc.; and, WHEREAS, the Assistant City Manager, John Buss, recom- mends the amendment of said contract by Change Order No. 9 attached hereto as Exhibit "A ", which authorizes contractor to proceed with modifications to Lake Crook raw water piping to install a check valve by force account methods as spec- ified under Method C in Contract General Provisions, Part 6.03 with contract period being extended by one day for each actual full day worked on this modification and for the number of whole days summed from the number of fractional days worked on this modification; and, WHEREAS, in the event contractor is not agreeable to Change Order No. 9 then said modification should be accom- plished by force account or separate contract as well best serve the interest of the City of Paris; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the contract for Additions to the Water Treat- ment Plant is hereby amended by Change Order No. 9 attached hereto as Exhibit 'A" and the Mayor of the City of Paris, Billy Joe Burnett, is hereby authorized and directed, on behalf of the City of Paris, to execute said Change Order. BE IT FURTHER RESOLVED, That in the event the contrac- tor refuses to agree to Change Order No. 9 then it is hereby authorized and directed that the modification on said Change f Order No. 9 be accomplished by force account or by.separate contract as will best serve the interest of the City of Paris.
